Planning Commission Meeting Minutes <br /> July 19, 2005 <br /> Page 14 <br /> 1 to sign off on it in an effort to move it forward and if it is deemed to be more significant it could <br /> 2 then be reviewed by the Planning Commission. He stated that their time would be better spent <br /> 3 by trying to find a way to have a code amendment that wouldn't prohibit the process, if they <br /> 4 weren't specifically listed and gave staff more latitude in the spirit of the code and if it truly is a <br /> 5 gray area then testimony from the residents to the Planning Commission could then help to <br /> 6 resolve issues. <br /> 7 <br /> 8 Chair Stromgren agreed stating that this was the reason for driving it forward to allow the smaller <br /> 9 lots redevelopment. He stated that they were aware that these issues would come up as the <br /> 10 homes age. <br /> 11 <br /> 12 Commissioner Jensen provided an example stating that how this egress pit could be worded is <br /> 13 that the first person in would win adding that they would have a condition that the person next <br /> 14 door would not be able to install a pit within ten to fifteen feet of the existing pit and they would <br /> 15 probably have a fence to deal with it. He noted that there is nothing in the code that would <br /> 16 prohibit plants or other things that create the same kinds of obstructions. He stated that they do <br /> 17 have a lot of gray area and for an overall benefit on issues like this it would be better done <br /> 18 administratively. <br /> 19 <br /> 20 Ms. Moore-Sykes stated that she would contact the City of Bloomington and get the information <br /> 21 to see what could be included within the City ordinances. She stated that she would also review <br /> 22 the information with the City Council and the City Attorney to see how it could work within our <br /> 23 ordinances and try to bring something back to the Planning Commission for their review in <br /> 24 August or September. <br /> 25 <br /> 26 XI. ANNOUNCEMENTS <br /> 27 <br /> 28 Ms. Moore-Sykes referenced a letter from Rose Fitzgerald, Manager of Autumn Woods <br /> 29 Apartments, regarding Hannay's Boat and Marine adding that she submitted photographs of what <br /> 30 it looks like in Minneapolis. She noted that she did respond to Ms. Fitzgerald's letter and also <br /> 31 provided the Commission with a copy of the letter for review. She stated that staff would <br /> 32 monitor and keep an eye on this concern going forward. <br /> 33 <br /> 34 Chair Stromgren stated that he is not sure,based on the photographs, what is in violation. <br /> 35 <br /> 36 Ms. Moore-Sykes explained that anything on display outside has to be moved back inside at the <br /> 37 end of the business day. <br /> 38 <br /> 39 Chair Stromgren clarified that they do have a small fenced area on the west side of the building <br /> 40 that is hidden from view, except for Autumn Woods. He noted that when he has looked at that <br /> 41 area it appears to always be full adding that the applicant was very clear that he was not going to <br /> 42 store anything inside that area. <br /> 43 <br /> 44 Commissioner Young asked if they know what the City of Minneapolis' code is for this property. <br /> 45 Ms. Moore-Sykes stated that it is a commercial area and they do allow some outside storage. <br />
