Attachment to the Petition for Variance <br /> Condition 1 <br /> For personal safety reasons we want to install an egress window to the basement. The <br /> width of the lot is smaller than the current lot size requires. Also the home was built <br /> before current building codes for emergency escape and rescue were established. The <br /> existing lot will not permit the installation of a basement emergency exit egress window <br /> and window well on the west side of the property without encroaching into a required 5 <br /> foot side yard. The existing side yard is approximately 5 feet. The installation of the <br /> window well will project 3 feet into yard from the house leaving 2 feet to the property <br /> line. <br /> Condition 2 <br /> The purpose of this request is to ensure access to an emergency egress window from the <br /> basement of the house as required by current codes. The current City Ordinance requires <br /> a side yard of 5 feet. The existing house is approximately 5 feet from the property line <br /> and will not permit this installation without a variance. <br /> Condition 3 <br /> The current City Ordinance requires a minimum 5 feet side yard. While the Minnesota <br /> Building Code requires that if a portion of the basement is habitable space that at least <br /> one emergency egress window is provided. The existing house is approximately 5 feet <br /> from the property line and will not permit this installation without a variance. <br />
