AnthonySt • <br /> -Memo <br /> TO: Kim Moore-Sykes <br /> Fronx John Malenick, Fire Chief <br /> Date: July 18,2005 <br /> Re: BBQ's on Balconies <br /> In regard to City Ordinance 1325.12 disallowing open flames on balconies, the St. <br /> Anthony Fire Department does not at this time nor do we foresee a future need to <br /> alter our current code. <br /> Multiple Dwellings, buildings with three or more dwelling units, have always been and <br /> will continue to be what we consider a high risk to life safety. These are places where <br /> the careless or malicious acts of one individual can endanger and disrupt the lives of <br /> many others. Because of this, certain freedoms must be limited by city, state and <br /> federal law, open flame in multiple dwellings being just one of countless legislation. <br /> Where state law allows some leeway to the local jurisdiction, our city ordinance has <br /> restricted and reflected our discretion in this case. <br /> In addition, our experience in enforcing other housing ordinances prompts us to <br /> consider secondary offenses that may arise from the use of barbeques in close <br /> proximity to one's neighbors. I have no doubt the smoke and odor (though enjoyed <br /> by me) will be found offensive to some others.
