STAFF REPORT <br /> To: Planning Commission Report No.: VIII.1 <br /> From: Kim Moore-Sykes,Assistant City Manager <br /> Date: July 19,2005;August 16,2005 <br /> Subject: Concept Review R-2 Rezoning Request for 3645 Chelmsford Road <br /> Date Application Received: July 19, 2005 <br /> Property Address: 3645 Chelmsford Road <br /> Zoning District: R-1 <br /> 60-Day Expires: 9/19/05;waived as missed 7/19 concept review, extension requested <br /> to 60-Day Rule. Scheduled for Public Hearing on 9/20/05; Council <br /> action on 9/27/05. Spoke with petitioner via phone on 7/26/05. <br /> Requested Action: <br /> Staff is asking the Planning Commission to review a request by Troy Martenson,owner of 3645 Chelmsford <br /> Road to rezone 3645 Chelmsford Road,from R-1 Single-family Zoning District to R-2 Two-Family Zoning <br /> District. <br /> Background: <br /> Currently,the property is zoned R-1,has an existing single-family structure on the lot and is a comer lot. <br /> The lot size is 19,260 SF (107' x 180')with_a 75' utility easement given to Xcel Energy and is across the <br /> northern portion of the lot. The property adjacent to the east is zoned R-2;the properties directly across 37th <br /> Avenue to the north are zoned R-4. There have been several attempts to split this lot but because of the <br /> utility easement,these requests have either been denied by the City or upon discovering the easement, <br /> petitioners have cancelled their applications. <br /> The owner also went before Council at its June 21St meeting with a petition for an R-3 Townhouse Zoning <br /> District rezoning request. The Council denied the request due to concerns about spot zoning. <br /> Mr. Martenson is now proposing to submit a rezoning request that would-change the current zoning of R-1 <br /> to R-2. The R-2 Zoning District requires that a corner lot have an area of 14,000 SF and 100 feet in width at <br /> that building setback line.
