Planning Commission Meeting Minutes <br /> September 20, 2005 <br /> Page 3 <br /> 1 Commissioner Jensen referenced Condition 3, which states that there would be no cooking of <br /> 2 food on site and asked if there is any possibility of cooking actually taking place anywhere on the <br /> 3 site. <br /> 4 <br /> 5 Ms. Moore-Sykes assured the Commission that there would be no cooking of food on this site as <br /> 6 there are no actual cooking facilities, such as a stove, convection oven or grill, located at the site. <br /> 7 <br /> 8 Chair Stromgren further clarified stating that approval hinges on the design of the kitchen and <br /> 9 compliance with Health Department standards. He stated that based on the equipment they have <br /> 10 on site there is no issue with regards to what they would be able to do outside of warming <br /> 11 prepared food. <br /> 12 <br /> 13 Vice Chair Hanson asked if they should include a section that would clarify and outline the hours <br /> 14 of operation for the facility. <br /> 15 <br /> 16 Commissioner Jensen stated that the hours of operation for facilities in an industrial zone are not <br /> 17 usually regulated and asked what it would prevent. <br /> 18 <br /> 19 Chair Stromgren stated that it could be included as a condition noting that the liquor licensing <br /> 20 would help to govern the hours of operation for the facility. <br /> 21 <br /> 22 Motion by Commissioner Jensen, second by Vice Chair Hanson, to recommend approval of the <br /> 23 Conditional Use Permit for catering activities at 2829 Anthony Lane South as submitted. <br /> 24 <br /> 25 Chair Stromgren stated that he would like to add a friendly amendment to restrict the hours of <br /> 26 operation to 10:00 a.m. to 1:00 a.m. <br /> 27 <br /> 28 Motion by Chair Stromgren, second by Commissioner Jenson, to accept the proposed friendly <br /> 29 amendment as Condition 7 to state that the hours of operation are restricted to 10:00 a.m. to 1:00 <br /> 30 a.m. <br /> 31 <br /> 32 Commissioner Jensen accepted the friendly amendment. <br /> 33 <br /> 34 Motion carried unanimously <br /> 35 <br /> 36 7.2 Conditional User Permit Request—Drive-through for Snyder's Drugs <br /> 37 <br /> 38 Chair Stromgren opened the public hearing at 7:17 p.m. <br /> 39 <br /> 40 Ms. Moore-Sykes stated that the City received a request from David Leonard, Snyder's Drug <br /> 41 Stores, Inc., for a Conditional Use Permit for a drive-through window, as required by the City's <br /> 42 Zoning Code. She provided the Commission with a brief overview of the request noting that Mr. <br /> 43 Leonard appeared before the Planning Commission in a concept review at their August 16, 2005 <br /> 44 meeting, proposing to move Snyder's Drug Store from its current location in the St. Anthony <br /> 45 Shopping Center to the end cap unit in the St. Anthony Marketplace.
