STAFF REPORT <br /> To: Planning Commission Report No.: VII.3 <br /> From: Kim Moore-Sykes,Assistant City Manager 06 <br /> Date: September 20, 2005 <br /> Subject: R-2 Rezoning Request for 3645 Chelmsford Road <br /> Date Application Received: July 19,2005 <br /> Property Address: 3645 Chelmsford Road <br /> Zoning District: R-1 <br /> 60-Day Expires: 9/19/05; waived as missed 7/19 concept review,extension requested <br /> to 60-Day Rule. Scheduled for Public Hearing on 9/20/05; Council <br /> action on 9/27/05. Spoke with petitioner via phone on 7/26/05. <br /> Requested Action: <br /> Staff is asking the Planning Commission to consider a request by Troy Martenson, owner of 3645 <br /> Chelmsford Road to rezone this property, from R-1 Single-family Zoning District to R-2 Two-Family Zoning <br /> District. <br /> Background: <br /> Currently, the property is zoned R-1,with an existing single-family structure on the lot. It is a corner lot <br /> with a 75' utility easement given to Xcel Energy that goes across the northern portion of the lot. The <br /> property adjacent to the east is zoned R-2; the properties directly across 37th Avenue to the north from the <br /> subject property are zoned R-4. There have been several attempts to split this lot previously but because of <br /> the utility easement, these requests have either been denied by the City or upon discovering the easement, <br /> petitioners have cancelled their applications. <br /> The current owner also went before the City Council at its June 21St meeting with a petition for an R-3 <br /> Townhouse Zoning District rezoning request. The Council denied the request due to concerns about spot <br /> zoning. Mr. Martenson is now proposing to submit a rezoning request that would change the current <br /> zoning of R-1 to R-2 and presented his concept to the Planning Commission at a concept review at the July <br /> 19th Planning Commission meeting. As stated earlier, the property adjacent to the subject property is <br /> currently zoned R-2, despite its current structure being used as a single-family residence. <br /> The R-2 Zoning District requires that a corner lot have an area of 14,000 SF and 100 feet in width at that <br /> building setback line. Based on two different sources,Staff has varying information about the square <br /> footage of the subject lot. The plat map that the City receives from Hennepin County shows that the lot is <br /> 107' x 220' (23,540 SF) while the information from Hennepin County's web site shows the lot as 107' x 180' <br /> (19,260 SF). The enclosed copy of a survey of the lot shows an 18' x 220' roadway easement that mostly <br /> accounts for the discrepancy in the square footages.
