Planning Commission Meeting Minutes <br /> August 16, 2005 <br /> Page 4 <br /> 1 out to the pad site and make it bigger. He stated that they are aware of the requirements that at <br /> 2 least 50-percent of the sales must be food and they are prepared to adhere to these requirements. <br /> 3 He stated that they should be able to work with the recommendations for the boulevard <br /> 4 landscaping and have shared the recommendations with the applicant. <br /> 5 <br /> 6 Commissioner Jensen referenced the condition included in the Staff summary talks about the <br /> 7 hours for outdoor seating are not to exceed 10:00 p.m. and asked if this is a serving issue that <br /> 8 previous Council's or Planning Commission's had or is this a concern of the operator. He asked <br /> 9 if the intent of the condition is to bring people into the restaurant after 10:00 p.m. <br /> 10 <br /> 11 Chair Stromgren clarified that the reason for the condition was due to the concerns with outdoor <br /> 12 noise after 10:00 p.m. due to the adjacent residential areas. <br /> 13 <br /> 14 Mr. Tucci indicated that the condition was similar to the original adding that they would have <br /> 15 preferred a later timeframe but they understand the concerns expressed by the residents and they <br /> 16 do not have an issue with the timeframe. <br /> 17 <br /> 18 Commissioner Jensen stated that in the past there was discussion about creating trail linkages <br /> 19 with the walkways noting that the connections are not shown on the site plan. He asked that they <br /> 20 include the connections to the sidewalk, the parkway and bus stop area. Mr. Tucci stated that <br /> 21 they could include the connections that extend out to the west along the parkway area and <br /> 22 reviewed the connections with the Commission. <br /> 23 <br /> 24 Commissioner Jensen clarified that he would like to see connections to the walkway around the <br /> 25 perimeter from both the east and west areas. Mr. Tucci stated that they would work with the City <br /> 26 Engineer on the details. <br /> 27 <br /> 28 Chair Stromgren closed the public hearing at 7:19 p.m. <br /> 29 <br /> 30 Motion by Commissioner Jensen, second by Commissioner Hoska, to recommend approval <br /> 31 Resolution 03-052, a Resolution relating to Conditional Use Permit requests for the proposed <br /> 32 redevelopment of the corner of Kenzie Terrace and Highway 88 for a Restaurant located within <br /> 33 250-feet from a residential district and to include conditions A through I, as referenced in the <br /> 34 Staff Report. <br /> 35 <br /> 36 Motion carried unanimously <br /> 37 <br /> 38 Chair Stromgren stated that the next motion is to consider recommending approval for the <br /> 39 reduction in the setback from the 35-foot front yard to 12-feet, bearing in mind that this is a <br /> 40 comer condition, not a entire side or elevation of the building. <br /> 41 <br /> 42 Commissioner Jensen stated that Item A in the Staff Report is a hold over and recommended that <br /> 43 Item <br /> A be struck as it is no longer relevant. He stated that Item Dhas a co-mingled discussion <br /> 44 about blighted buildings and without that today, it is not blighted. He stated that they could still <br /> 45 make a finding for the variance regardless of the discussion around blighted buildings. <br />
