Planning Commission Meeting Minutes <br /> August 16, 2005 <br /> Page 6 <br /> 1 applicant has indicated that the catering facilities would be used mainly on the weekends. She <br /> 2 stated that as proposed, the changes to the text would in the uses as permitted in an L1 District <br /> 3 only by a conditional use permit issued by City Council and reviewed the conditions with the <br /> 4 Commission. <br /> 5 <br /> 6 Eric Reiners, Architect with Welman Sperides Architects and representative for the International <br /> 7 Union of Operating Engineers, Local 49, stated that the proposal is basically unchanged from the <br /> 8 Concept Review. He reviewed the recent addition and renovations with the Commission noting <br /> 9 that Local 49 has been a good neighbor in the City of St. Anthony for a long time. He stated that <br /> 10 when the 49er's remodeled the area it was done primarily for their use during their monthly and <br /> 11 annual membership meetings. He explained that they had a small service area at the north end of <br /> 12 the meeting hall where they served refreshments and snacks and when it was remodeled it was <br /> 13 done with the intent to provide catering services. He stated that Prom Catering would be the <br /> 14 contractor and has expressed interest in opening their services to the public. He assured the <br /> 15 Commission that the facilities would be used mainly on weekends for outside groups for events <br /> 16 such as weddings and family reunions. <br /> 17 <br /> 18 Chair Stromgren closed the public hearing at 7:32 p.m. <br /> 19 <br /> 20 Motion by Vice Chair Hanson, second by Commissioner Hoska, to recommend approval of the <br /> 21 City Code Text Change and Conditional Use Permit Request for 2829 Anthony Lane South, <br /> 22 following uses are allowable in Industrial District, Letter H, I. <br /> 23 <br /> 24 Motion carried unanimously <br /> 25 <br /> 26 7.3 2_909—30th Avenue NE—Variance to Allow Egress Windows in Side Yard Setbacks <br /> 27 <br /> 28 Chair Stromgren opened the public hearing at 7:35 p.m. <br /> 29 <br /> 30 Ms. Moore-Sykes stated that the property owners of 2909-30th Avenue NE, Marcus and Ramona <br /> 31 Steadman, are petitioning for a 3-foot variance to the Zoning Code to be allowed to install an <br /> 32 egress window in the 5-foot side yard setback on the west side of their property. She stated that <br /> 33 by omission from the Zoning code, egress windows are not a permitted use or allowed as an <br /> 34 encroachment into the side yard setback of the R-1 Zoning District. She referenced section <br /> 35 1600.03, Uses Not Specified, noting that it states that if a use is not specifically permitted, <br /> 36 permitted by conditional use permit or prohibited, the use will be considered prohibited; and <br /> 37 Section 1650.03, Encroachment in Yards, does not include egress windows as an allowed <br /> 38 encroachment. She indicated that the property owners have reported that the west side yard of <br /> 39 their property is the only feasible place for the installation of an egress window, as the east side <br /> 40 of their house has a driveway and the room that requires the egress window is at the west end of <br /> 41 the house. She stated that the applicants did consider locating the egress window in the front of <br /> 42 the house at the suggestion of Staff, but upon investigation discovered that the gas main enters <br /> 43 the structure through the front of the house. She stated that the front of the house also has a stone <br /> 44 fagade that the owners have reported as original and would be difficult to replace or repair. <br /> 45 <br />
