Planning Commission Meeting Minutes <br /> September 20, 2005 <br /> Page 10 <br /> 1 Ms. Moore-Sykes stated that Staff has recently received several complaints from residents about <br /> 2 all the vehicles for sale at Wiltshire Park School parking lot. She stated that because this is not <br /> 3 listed as allowable in the Zoning Ordinance for any zoning district, selling vehicles in this <br /> 4 manner is not allowed. She stated that vehicles parked on public property or public right-of-way <br /> 5 would be cited and towed at the owner's expense. She explained that Wiltshire Park is <br /> 6 considered private property and as such, the police can only respond if and when there is a call <br /> 7 from the school staff. She further explained that the Police and the Public Works Department <br /> 8 have been working with the school staff to determine a resolution to this situation and as a result <br /> 9 of Staff discussion, she has received a copy of the City of Falcon Heights' ordinance regarding <br /> 10 vehicle sales. She stated that the ordinance language was used as an example of a possible <br /> 11 ordinance that the City could adopt to alleviate the situation. She stated that the proposed <br /> 12 language was sent to the City Attorney and the Police Department for their comments. She <br /> 13 stated that the Police Department has been working with the school board and that signs are now <br /> 14 posted in the area that states parking is not permitted in the area and would be enforced. She <br /> 15 reviewed the proposed text changes with the Commission. <br /> 16 <br /> 17 Chair Stromgren closed the public hearing at 7:54 p.m. <br /> 18 <br /> 19 Commissioner Jensen asked what the consequence would be if someone violates the posted signs <br /> 20 <br /> 21 <br /> 22 Ms. Moore-Sykes explained that this would give the Police Department the opportunity to cite <br /> 23 the individual or tow the vehicle if it is on private property, such as Wiltshire Park. <br /> 24 <br /> 25 Commissioner Jenson asked if public property would include parking in front of a house or in a <br /> 26 driveway. <br /> 27 <br /> front of a house would be considered public property <br /> 28 Ms. Moore-Sykes confirmed that parking in <br /> 29 and the vehicle would have to be pulled into the driveway. <br /> 30 <br /> 31 Commissioner Jensen asked if this would also include all recreational vehicles. <br /> 32 <br /> 33 Ms. Moore-Sykes confirmed that it would include recreational vehicles such as boats on trailers, <br /> 34 snowmobiles and four-wheelers. She explained that if the school has a vehicle for sale they <br /> 35 would be able to display the vehicle because they own the property but another individual would <br /> 36 not be able to park or display their vehicle on school property because they do not own the <br /> 37 property. She stated that the proposed ordinance clearly states that it does have to be the <br /> 38 residence of the resident where the vehicle is parked.
