A change in tenancy, ownership or management will not affect the <br /> status of a non-conforming use if the use remains the same. <br /> Notwithstanding the forgoing, this Section shall not effect the rights of <br /> the City or residents in any written agreement to the contrary entered into <br /> prior to April 5, 2005. <br /> D. Non-Conforming Signs. <br /> 1. Business signs on the premises of a non-conforming building or use <br /> may be continued but such signs shall not be increased in number, area, <br /> height, or illumination. New signs not to exceed thirty-five (35) square <br /> feet in aggregate sign area may be erected only upon the complete <br /> removal of all other signs existing at the time of the adoption of this <br /> Ordinance. Such signs may be illuminated but no flashing, rotating, or <br /> moving signs shall be permitted. <br /> 2. Non-Conforming Buildings or Structures. <br /> 1. Restoration. No building or other structure which has been damaged <br /> by fire, explosion, act of God, or any other cause, to the extent of more <br /> than fifty percent (50%) of its current City assessed market value shall be <br /> restored except in conformity with the regulations of this Ordinance. <br /> Estimates of the extent of damage shall be made by the City. <br /> 2. Expansion. Non-conforming principal and accessory structures shall <br /> not be enlarged or altered in a way which increases their non-conformity. <br /> Non-conforming accessory structures, which are totally within a required <br /> yard setback, shall not be enlarged or expanded in any way. <br /> 3. If a non-conforming structure is moved for any distance whatsoever; it <br /> shall conform to the regulations for the district in which it is located after <br /> it is moved. <br /> 4. Normal repairs and maintenance necessary to keep a non-conforming <br /> structure in sound condition shall be permitted. <br /> 5. Residential Buildings.
