6. A significant amount of secondhand smoke exposure occurs in the workplace. <br /> Employees who work in smoke-filled businesses suffer a 25-50% higher risk of <br /> heart attack and higher rates of death from cardiovascular disease and cancer, <br /> as well as increased acute respiratory disease and measurable decrease in lung <br /> function. <br /> 7. Smoke-filled workplaces result in high worker absenteeism due to respiratory <br /> disease, lower productivity, higher cleaning and maintenance costs, increased <br /> health insurance rates, and increased liability claims for diseases related to <br /> exposure to secondhand smoke. <br /> 8. Smoking is a potential cause of fires. <br /> 9. Accordingly, the Eden Prairie City Council finds and declares that the purposes <br /> of this ordinance are 1) to protect the public health and welfare by prohibiting <br /> smoking in city facilities and parks. <br /> B. Definitions: <br /> 1. "City Facilities" means buildings owned or operated by the City, including owned <br /> or operated outdoor areas of the lot or parcel on which the building is situated. <br /> 2. "Parks" means any open or enclosed land and improvements or facility <br /> wherever located which is owned, leased or operated by the City and which is <br /> reserved, designated or used for a playground, picnic area, garden area, beach, <br /> or other recreational or open space area. <br /> 3. "Smoking" means inhaling, exhaling, burning, or carrying any lighted cigar, <br /> cigarette, pipe, weed, or plant in any manner or in any form. <br /> Subd. 2. General Restrictions_ <br /> A. Prohibition of Smoking in Certain Areas. Smoking is prohibited in the following areas: <br /> 1. Parks; <br /> 2. City Facilities; <br /> 3. Inside motor vehicles owned or operated by the City when occupied by two or <br /> more persons. <br /> 4. Inside motor vehicles at City Facilities and Parks. <br /> B. Where Smoking Not Regulated. Notwithstanding any other provision of this Section to <br /> the contrary, the following areas shall be exempt from the provisions of this Section: <br />
