Enclosed <br /> please find a receipt in the amount of$130 submitted for the Conditional Use Permit <br /> application fee. <br /> Minnesota State Statutes require that any land use or zoning related applications be <br /> approved or denied by the governing body within 60 days of receipt of the completed <br /> application by the political subdivision. To be in compliance with this statute,the City <br /> responds to submitted applications in the following manner. <br /> DOM ZUM's request for the above-listed action for The Landing's at Silver Lake Village <br /> will be presented to the Planning Commission for an informal concept review on <br /> February 21,2006 and public hearing before the Planning Commission on March 21, <br /> 2006. Following this public hearing,the Planning Commission,which is an advisory <br /> body to the City Council,will make their recommendation for approval or denial to the <br /> City Council. The City Council will make a decision on your application at the March <br /> 28,2006 Council meeting the following week. <br /> The Planning Commission meets once a month. Because of all of the statutory noticing <br /> requirements,the City needs thirty(30) days prior to a Planning Commission meeting to <br /> comply with these requirements. Your application did not make the City's deadline of <br /> January 17,2006,which is approximately thirty(30) days before the February Planning <br /> Commission meeting,and so was not included on the February agenda. This situation <br /> also puts the City out of compliance with the state's 60-Day Rule by five (5) calendar <br /> days. As such,the City does have the responsibility to advise you of this situation and <br /> to also advise you that we will be extending the time requirements of the 60-Day Rule to <br /> include March 28,2006,which is the date of the City Council meeting that will be <br /> Our Mission is to be a progressive and livable community, a walkable village, which is safe and secure. <br />
