Extra-territorial subdivision regulation <br /> Minn.Stat.§462.358,subd 1a. .As discussed with regard to zoning, cities may,by resolution, extend their <br /> See A.G.Op.59-A-32(Aug. 18, subdivision regulations to unincorporated territory located within two miles <br /> 1995). of its boundaries in any direction, except for a town that has adopted <br /> subdivision regulations. If two or more non-contiguous cities have <br /> boundaries less than four miles apart, each may control the subdivision of <br /> land at equal distance from its boundaries within this area. Enforcement <br /> procedures are the same as if the regulation occurred inside the city's <br /> boundaries. The enforcement authority continues until the county or town <br /> board adopts comprehensive regulations that encompass the unincorporated <br /> territory. <br /> Minn.scat §462.358. Another option is available with regard to regulation in these unincorporated <br /> areas.Upon the request of a city, county or the adjacent town,the involved <br /> parties must set up a board to exercise planning and land use control authority <br /> in those areas within two miles of the corporate limits of the city. The board <br /> must have an equal number of members from the city, county, and town <br /> appointed by their respective governing bodies. <br /> Minn.Stat.§§462.351 to This board serves as a governing body,having all of the authority provided in <br /> • 462.364. the Planning Act and a board of adjustments and appeals with respect to land <br /> use issues in the unincorporated areas.Additionally,the board has the <br /> authority to adopt and enforce the uniform fire code within its jurisdiction. <br /> Unless the parties agree to an alternative arrangement,the city is required to <br /> provide staff for the preparation and administration of land use controls. <br /> XII. The official map <br /> Minn.stat §462.359. As a planning tool, official maps ensure that land the city needs for street <br /> widening, street extensions, future streets, and other public purposes will be <br /> available at basic land prices. To accomplish this, cities have authority to <br /> adopt official maps that lay out new streets across unplatted territory, <br /> showing future widening or extensions of existing streets and other public <br /> uses. While the planning agency or commission can prepare the map, the <br /> council must approve the map before it has any legal effect.
