COMMUNICATION WITH CITY COUNCIL <br /> 3 <br /> 4 6.1 March 28, 2006 City Council Meeting Designee <br /> 5 <br /> 6 Chair Stromgren stated that Commissioner Jan Jenson would attend the March 28, 2006 City <br /> 7 Council meeting. <br /> 8 <br /> 9 VII. PUBLIC HEARING. <br /> 10 <br /> 11 7.1 Conditional Use Permit—Dominium. LLC <br /> 12 <br /> 13 Chair Stromgren opened the public hearing at 7:05 p.m. <br /> 14 <br /> 15 Ms. Moore-Sykes stated that on January 23 2006 Staff received an application for a Conditional <br /> 16 Use Permit from Ms. Tonya Schelitzche, Dominium, Inc. for a beauty salon at the Active Seniors <br /> 17 Community of The Landings at Silver Lake Village. She explained that The Landings would like <br /> 18 to include a beauty salon as a personal service for their residents only. She said that because the <br /> 19 application was complete and included the fee,the City has to abide by the 60-Day Rule, which <br /> 20 requires a jurisdiction to take action on a zoning application within 60 days. She stated that a <br /> 21 letter was sent explaining that the City would require an extension of five days in order to <br /> 22 complete the review process and to take action on their request. She explained that Dominium <br /> 23 submitted an application for a conditional use permit for a beauty salon in The Landings at the <br /> 24 Silver Lake Active Senior Community. She noted that The Landings is located at the Silver Lake <br /> 25 Village, which is designated a Mixed Use PUD. She stated that properties that are designated as <br /> 26 a PUD generally have more flexibility in planning and may include only those uses generally <br /> 27 considered associated with the general land use category according to the Comprehensive Land <br /> 28 Use Plan. She noted that the City Code does state that in some unique situations,the PUD may <br /> 29 allow the approval of use or uses that are not listed as either permitted or conditional uses in any <br /> 30 underlying zoning district. She stated that Staff recommended that the property owner secure a <br /> 31 CUP because while this use is allowed in the Commercial Zoning District, it is not normally an <br /> 32 allowable use in a Residential Zoning District. She stated that Staff recommends approval of the <br /> 33 Conditional Use Permit based on the following conditions: Salon employees must be licensed by <br /> 34 the State Board of Barbers and Cosmetology; they must comply with State and County Public <br /> 35 Health Regulations for Salon operation; no external signage advertising the salon's services or <br /> 36 location; The salon exists for the convenience and service of The Landings' residents. <br /> 37 <br /> 38 Justin Parr, Dominium,provided the Commission with a brief overview of the application for a <br /> 39 Conditional Use Permit. He explained that it is their plan to provide a beauty salon as a service <br /> 40 to the residents of The Landings and he assured the Commission that the service is only for the <br /> 41 residents of The Landings,that there would not be any signage or advertising and that the salon <br /> 42 would be staffed by licensed,third party individuals. <br /> 43 <br /> 44 Chair Stromgren closed the public hearing at 7:10 p.m. <br /> 45 <br />
