STAFF REPORT
To: Planning Commission Report No.: VIII.1
From: Kim Moore-Sykes,Assistant City Manager
Date: October 17, 2006 v
Subject: 3609 Downers Drive NE
Requested Action: Concept Review — Variance for Stoop Encroachment in Front Yard
Date Application Received: October 3, 2006
Property Address: 3609 Downers Drive NE
Zoning District: R-1
60-Day Expires: December 2, 2006
Waiver Letter Required: Yes Date Sent; X No
*Action on this application is scheduled for November 28, 2006,
therefore is not subject to the Minnesota 60-Day Rule.
Action: Concept Review
Background: Staff was contacted by Mr. Mark Shadduck, owner of 3609 Downers Drive NE, to get
information regarding removing and replacing his concrete driveway. He then asked what the process would be
if he wanted to expand and replace the front stoop and steps. Staff informed him that he would need to
determine how far from the front yard setback the current stoop is situated and that the City's ordinance does
allow an encroachment of a front stoop by 5 feet (1650.03, Sub. (d)). Mr. Shadduck explained that he cares for
an elderly parent and having the stoop widened an additional 12 inches would make it easier to assist his parent
in and out of the home. The owner also said that the drip line of the roof causes a slippery situation with rain
and an icy situation in the winter. Mr. Shadduck feels that widening the front stoop would reduce the unsafe
impact that the drip line would have for the front stoop.
The right-of-way is ten feet from the curb to the lot line and the front yard setback, which is 30 feet from the lot
line to the house, a measurement that was substantiated by a lot survey done in 1992 by Kemper Surveyors.
According to the property owner, the existing front stoop is approximately eight feet into the front yard, three
more feet than the City ordinance allows. The house was constructed in 1965, making the current front stoop
grandfathered-in.
Attachments:
• Application and attachments from Mr. Mark Shadduck.
101706 concept review Shadduck 3609 Downers.doc
