PUBLIC HEARINGS <br /> 5 <br /> 6 VII.1 Lot Subdivision for 4020 Silver Lake Terrace and 4024 Silver Lake Terrace <br /> 7 <br /> 8 Chair Stromgren opened the public hearing at 7:04 p.m. <br /> 9 <br /> 10 Assistant City Manager Moore-Sykes presented the staff report on the requested lot <br /> I 1 subdivision/combination for properties located at 4020 Silver Lake Terrace and 4024 Silver Lake <br /> 12 Terrace. She stated Elizabeth and Paul Hayes, property owners at 4020 Silver Lake Terrace, Lot <br /> 13 4, Block 1, Olson's Addition, are proposing to sell a 337 SF portion of their lot at the NW corner <br /> 14 to Dr. Gary Good,property owner of the adjacent property, 4024 Silver Lake Terrace, Lot 3, <br /> 15 Block 1, Olson's Addition. Dr. Good is proposing to sell approximately 3,062 SF to Mr. and <br /> 16 Mrs. Hayes in order to give the Hayes' more lakeshore for recreation. Both property owners have <br /> 17 applied for subdivision and plat approvals to accommodate each of their lot splits and lot <br /> 18 combinations. Both owners were informed that this land use action requires a public hearing. Mr. <br /> 19 Paul Hayes, 4020 Silver Lake Terrace, initially contacted staff to determine if he and his <br /> 20 neighbor, Dr. Gary Good, 4024 Silver Lake Terrace, could sell each other portions of their <br /> 21 respective property. Staff provided Mr. Hayes with information regarding the lot subdivision <br /> 22 process. Mr. Hayes advised staff that Dr. Good intended to sell him a portion of property that <br /> 23 runs along the easement that goes from Silver Lane to the Lake. <br /> 24 <br /> 25 Assistant City Manager Moore-Sykes stated on August 27, 2008, staff received site plan review <br /> 26 applications and subdivision/plat approval applications with a survey map of the subject lots <br /> 27 from both Paul and Elizabeth Hayes and Dr. Gary Good. Each respective application described <br /> 28 the lot subdivision and lot combination proposed for each property. The proposed site map and a <br /> 29 description of the proposed subdivision were forwarded onto the City Attorney for review. He <br /> 30 did not find any issues of concern with the proposed lot subdivisions and combinations. Staff <br /> 31 received two phone calls asking about the proposed subdivision. One individual wanted to advise <br /> 32 the City that a walkway easement runs adjacent to the 3,062 SF that Mr. Hayes in buying from <br /> 33 Dr. Good. He wanted to insure that this easement providing access to Silver Lake is protected. <br /> 34 The other caller simply wanted more information about the proposed subdivision. <br /> 35 <br /> 36 Assistant City Manager Moore-Sykes stated staff has verified that the proposed lot splits do not <br /> 37 cause the whole lot to be out of conformance with lot size regulations of the City's Zoning Code. <br /> 38 Each lot meets the minimum lot size of 9,000 SF. Currently, Lot 3 is 22,948 SF and Lot 4 is <br /> 39 14,709 SF. The proposed square footage of Lot 3 is 20,223 and the proposed square footage of <br /> 40 Lot 4 is 17,434. According to the calculations of the certified land surveyor, the 35% lot <br /> 41 coverage requirement is also adhered to by both properties, currently and with the proposed <br /> 42 subdivision. Assistant City Manager Moore-Sykes advised that the minimum side yard and rear <br /> 43 yard setbacks for each lot are also maintained. An R-IA lot requires a minimum side yard width <br /> 44 of five feet and a minimum combination of the two side yards of 15 feet. The rear yard of any lot <br /> 45 not abutting the lake must be at least 75 feet from the natural high water elevation of the lake. <br /> 46 The rear yard of any lot not abutting the lake must be at lest 20% of the depth of the entire lot, <br />
