STAFF REPORT <br /> To: Planning Commission Report No.: VII.1 <br /> From: Kim Moore-Sykes,Assistant City Manager 14,W2 <br /> Date: October 21, 2008 <br /> Subject: 3523 Harding Street NE — Administrative Lot Combination <br /> Requested Action: Public Hearing of Administrative Lot Combination <br /> Date Application Received: October 23, 2008 <br /> Property Address: 3523 Harding Street NE <br /> Zoning District: R1 <br /> 60-Day Expires: December 22, 2008 <br /> Waiver Letter Required: Yes Date Sent: No X <br /> Future Action: Council Action at Council meeting on November 25, 2008 on Planning <br /> Commission's Recommendation. <br /> Background: In reviewing the applicant's demolition and building permits, Staff discovered that 3523 Harding <br /> is really two lots, one lot is 15'x130', Lot 3,Block 5, Gardena Acres and adjacent to another lot which is <br /> 60'x130', and also described by Hennepin County as Lot 3, Block 5, Gardena Acres. Both of these lots <br /> individually are not conforming with regard to square footage. Combined, these lots would be 9,750SF, meeting <br /> the City's Ordinance requirement of an interior lot being at minimum 9,000SF. A residential structure has <br /> existed on this site and possibly across both lots since 1957. Because both lots have the same legal description, <br /> Staff believes that at one time, there was intent to combine these lots. <br /> AFplication Review: Administrative Lot Combination. <br /> i <br /> Analysis: Due to the recent demolition of the residential structure at 3523 Harding, there was a significant <br /> reduction in market value of the property. Staff advised the contractor and Mr. Patrick O'Keefe, the owner, of <br /> the resultant non-conforming lots and that because of significant changes to the property, the City's Zoning <br /> Code requires these two lots need to be combined to alleviate this non-conforming situation. Staff further <br /> advised Mr. O'Keefe that the City would combine these two lots administratively provided, as the owner,Mr. <br /> O'Keefe is agreeable to the combination; that the combination of these lots is permanent; and that this newly <br /> combined parcel will be treated as one parcel for purposes of all applicable ordinances of the City and that the <br /> property line between the parcels be disregarded for purposed of the City's setback,building and zoning <br /> ordinances. <br /> Mr. O'Keefe agreed to the Administrative Lot Combination.
