The City Code defines fences to mean a partition, structure, wall or gate erected as a dividing
marker, barrier, enclosure or visual obstruction, but excluding buildings and bushes, trees and
other living landscaping. This ordinance does not differentiate between residential or recreational
or commercial fencing; it pertains to all fencing that meets the definition of fences as defined at
Subd. 1320.01.
Again, Minnesota State Statute states that the applicant for a variance must demonstrate that the
property owner's situation is unique and not created by the owner; that as a result of the City's
ordinances and strict enforcement, the owner is experiencing an undue hardship and the proposed
variance will not change the essential character of the neighborhood. The hardship argument
cannot be solely based on economics.
Attachments:
• Attorney's Opinion received by Staff from the St. Anthony Baseball Association
• School District Letter Supporting Proposal
Proposal for Signs on Palmer Field Fence 031709.doc
