The City Code defines fences to mean a partition, structure, wall or gate erected as a dividing <br /> marker, barrier, enclosure or visual obstruction, but excluding buildings and bushes, trees and <br /> other living landscaping. This ordinance does not differentiate between residential or recreational <br /> or commercial fencing; it pertains to all fencing that meets the definition of fences as defined at <br /> Subd. 1320.01. <br /> Again, Minnesota State Statute states that the applicant for a variance must demonstrate that the <br /> property owner's situation is unique and not created by the owner; that as a result of the City's <br /> ordinances and strict enforcement, the owner is experiencing an undue hardship and the proposed <br /> variance will not change the essential character of the neighborhood.
