9 <br /> 1 <br /> Planning Commission Regular Meeting Minutes ` <br /> March 17, 2009 <br /> Page 2 <br /> 1 Assistant City Manager Moore-Sykes discussed the history of the request for an administrative <br /> 2 lot split at 3055 Old US Highway 8. The item was included on the January 20, 2009 Planning <br /> 3 Commission meeting and tabled to the February 17, 2009 Planning Commission meeting at the <br /> 4 request of the applicant, Mr. David Lutz, General Counsel for The Wirth Companies. Mr. Lutz <br /> 5 did not attend the February 17, 2009 public hearing with the Planning Commission and did not <br /> 6 provide the parking analysis that had been requested until February 18, 2009. The revised site <br /> 7 plan that includes the parking analysis was forwarded to the City Attorney for review prior to the <br /> 8 City Council meeting scheduled for February 24, 2009. Mr. Lutz submitted a parking plan that <br /> 9 proposes 92 parking spaces with one space designated as handicapped parking. The City Council <br /> 10 remanded this item back to the Planning Commission for a public hearing scheduled for March <br /> 11 17, 2009. The City is still in conformance with the 120-day rule for Subdivision. Staff posted the <br /> 12 public hearing in the City's legal newspaper and mailed out notices to adjacent properties as <br /> 13 required by state statutes. <br /> 14 <br /> 15 Mr. David Lutz, General Counsel for The Wirth Companies, stated the Planning Commission has <br /> 16 been provided with the adjusted survey, which includes 92 parking spots and meets code <br /> 17 requirements. He stated he is available for questions. <br /> 18 <br /> 19 Chair Stromgren asked if the parking spaces included in the adjusted survey are proposed or <br /> 20 current parking spaces. Mr. Lutz replied the adjusted survey shows the actual number of spaces; <br /> 21 they believe they can be more efficient and include more parking spaces. <br /> 22 <br /> 23 Commissioner Crone questioned if the entrance would remain the same. Mr. Lutz responded in <br /> 24 the affirmative. <br /> 25 <br /> 26 Chair Stromgren closed the public hearing at 7:10 p.m. <br /> 27 <br /> 28 Commissioner Crone inquired if there is a need for a cross access agreement from one lot to the <br /> 29 other. Chair Stromgren indicated he does not believe this would be necessary until there is a <br /> 30 separate use for development. <br /> 31 <br /> 32 Commissioner Jenson noted the question of the Commission previously was the parking <br /> 33 arrangement and whether the parking meets the minimum requirement based upon building <br /> 34 utilization. <br /> 35 <br /> 36 Assistant City Manager Moore-Sykes indicated that the applicant has gone beyond the parking <br /> 37 requirement. <br /> 38 <br /> 39 Motion by Commissioner Jenson, seconded by Commissioner Heinis, to recommend approval of <br /> 40 the applicant's request for Lot Split at 3055 Old Highway 8. <br /> 41 <br /> 42 Motion carried unanimously. <br /> 43 <br /> 44 Chair Stromgren indicated that the lot split will be included on the March 24, 2009 City Council <br /> 45 meeting agenda. <br /> 46 <br />
