a10 <br /> LEAGUEOF CONNECTING & INNOVATING <br /> MINNESOTA SINCE 1913 <br /> CITIES <br /> RISK MANAGEMENT INFORMATION <br /> LMCIT COVERAGE FOR LITIGATION RELATING TO <br /> LAND USE REGULATION, DEVELOPMENT, <br /> FRANCHISING AND ENTERPRISE OPERATIONS <br /> Litigation relating to a city's land use regulation decisions, development and redevelopment <br /> activities, franchising, or city enterprise operations can be very expensive. For a city that's hit <br /> with this kind of litigation, the legal costs can be a significant financlal burden. For this reason, <br /> the League of Minnesota Cities Insurance Trust(LMCIT)developed a specialized approach to <br /> cover this type of litigation for Minnesota cities. <br /> Compared to conventional liability insurance, a key difference of the LMCIT coverage is that <br /> litigation relating to land use regulation, development or redevelopment, franchising, or enterprise <br /> operations is covered regardless of whether the litigation includes a claim for damages. Keep in <br /> mind this memo is only a summary of the coverage -the actual terms and conditions are defined <br /> by the LMCIT liability coverage document, and any specific coverage issues will be determined <br /> based on language in the coverage document. <br /> What types of litigation are covered? <br /> LMCIT provides coverage for four broad classes of Learn More <br /> litigation: <br /> LMCIT's coverage for land use, <br /> 1. Land use regulation. Any litigation relating to the development,franchising, and <br /> application, interpretation, or validity of a land use, enterprise operations litigation is <br /> zoning, subdivision, or similar ordinance or found in "Coverage D" of the <br /> regulation. LMCIT liability coverage <br /> 2. Development. Any litigation relating to the city's document. <br /> involvement in the financing or approval of any <br /> development of redevelopment project. <br /> 3. Franchising. Any litigation relating to the granting, refusal, interpretation, or enforcement of <br /> any franchise, ordinance, permit, license, or other mechanism through which the city <br /> authorizes or regulates parties other than the city, the provision of telecommunications, <br /> electricity, gas, heat, sewage treatment or refuse collection within the city. <br /> 4. Enterprise operations. Any litigation relating to a city's authority to engage in enterprise <br /> operations.
