STAFF REPORT <br /> To: Chair and Planning Commissioners <br /> From: Kim Moore-Sykes, Assistant City Manager �N6 <br /> Date: September 20,2011 <br /> Subject: 2824-2828 Anthony Lane South;LI CUP for Mountain of Fire Miracles Ministry <br /> Requested Action: Concept Review <br /> Date Application Received: August 17, 2011 <br /> Property Address: 2824- 2828 Anthony Lane <br /> Zoning District: Light Industrial <br /> 60-Day Expires: October 17,2011 <br /> Waiver Letter Required: Yes Yes Date Sent: No <br /> Future Action: Public Hearing <br /> Background. Staff met with Mr. Tom Baker,KW Commercial, and the applicant in April to discuss the <br /> proposed purchase of 2428 and 2828 Anthony Lane South and to use it as an assembly and meeting place <br /> for their members. Mr. Baker advised Staff that his client is the pastor of the Mountain of Fire Miracles <br /> Ministry,a Christian denomination based in Houston,TX. <br /> Mr. Baker and his client were advised by Staff of the need for a conditional use permit in order to use a <br /> property in the Light Industrial Zoning District as an assembly place. It was then that Staff discovered that <br /> as the result of the re-codification process,a portion of Section 152.142 PERMITTED CONDITIONAL USES <br /> that included (G) Assembly,meeting lodge or convention halls,was inadvertently removed and not <br /> published. This recodified Code was subsequently adopted by City Council without that language. When <br /> Staff discussed the issue with the City Attorney,he advised that since the Council had unintentionally <br /> adopted the recodified version without(G), the City Council would have to amend 152.142 to replace the <br /> missing language. The City Council did replace the omitted language and re-adopted the Code. Mr. Baker <br /> was then advised by the Staff to attend a concept review for their proposal. <br /> Staff has contacted the Fire Department to advise staff on any fire suppression needs for a potential <br /> occupancy of 200-400 people. This number was determined based on the information provided by <br /> Preliminary Furniture Plan. Parking may also have to be addressed. <br /> Staff has received calls from one of the tenants at 2428-2828 Anthony Lane South for status updates on the <br /> disposition of this application.
