38 St. Anthony - Land Usage <br /> cash escrow, letter of credit, or performance bond acceptable to the City Attorney equal to the citys <br /> estimated costs of improvements and all fees to be paid by the subdivider. <br /> (1993 Code,• 1500.07) <br /> •151.08 SUBDIVISION WITHOUT PLATTING. <br /> The City Council may waive compliance with the platting requirements of this subchapter and approve <br /> subdivision by conveyance of land by adoption of a resolution to that effect based upon findings by the <br /> City Council that: compliance with the platting requirements would create an unnecessary hardship or <br /> expense because of the nature of the subdivision,and failure to require the filing of a plat does not interfere <br /> with the purposes of this subchapter. The City Council may consider the number of parcels resulting from <br /> the subdivision,the complexity of the legal descriptions,the necessity for dedication of streets or drainage <br /> and utility casements, and the probability of future subdivision of the parcels. <br /> (1993 Code,• 1500.08) <br /> •151.09 BUILDING PERMIT. <br /> No building permit will be issued for the construction of any building, structure, or improvement on <br /> any land required to be subdivided by this chapter until all requirements of this chapter have been fully <br /> complied with. <br /> (1993 Code,• 1500.09) <br /> •151.10 CONVEYANCE BY METES AND BOUNDS FORBIDDEN. <br /> No conveyance by metes and bounds may be made or recorded if the parcel described in the <br /> conveyance is less than 2-1/2 acres in area or 150 feet in width, unless the parcel was a separate parcel of <br /> record on 8-22-1973. <br /> (1993 Code,• 1500.10) <br /> •151.11 VARIANCES. <br /> The City Council may authorize a variance from these regulations when,in its opinion,undue hardship <br /> may result from strict compliance. Any application for a variance will be dealt within the same manner as <br /> is provided in Chapter 152 relating to zoning variances. <br /> (1993 Code,• 1500.11) <br />
