Planning Commission Regular Meeting Minutes <br /> October 18, 2011 <br /> Page 4 <br /> 1 Commissioner Poucher noted that building permits are public record and the applicant could <br /> 2 have easily reviewed these records when she bought the house. <br /> 3 <br /> 4 Chair Jensen stated he was not sure he could support a motion that this is not in harmony with <br /> 5 the neighborhood. He added this may not have been the best design but it has not been a <br /> 6 detriment to her ability to live in harmony with the neighborhood. <br /> 7 <br /> 8 Motion by Commissioner Cincoski to recommend that the City Council approve a garage <br /> 9 setback permit and variance on the original existing garage from 5' to 2' due to its existence <br /> 10 prior to the City Code being written and to approve replacement of the garage addition because it <br /> 11 is in harmony with the existing neighborhood and not injurious to the neighborhood if rebuilt on <br /> 12 the existing slab. <br /> 13 <br /> 14 Commissioner Chaput stated that while he appreciates the applicant's desire to have additional <br /> 15 square footage, a non-conforming garage exists and this would be an opportune time to <br /> 16 reconfigure the slab where the existing garage is located and to align it with the slab from the <br /> 17 garage addition and then build a conforming structure. <br /> 18 <br /> 19 Mr. Belke stated the existing garage is undersized for what she has previously been able to have <br /> 20 and tearing out the back slab would require significantly changing the landscaping and driveway. <br /> 21 <br /> 22 Commissioner Chaput noted that the Planning Commission has no photographs that would show <br /> 23 what type of hardship that would be. <br /> 24 <br /> 25 Mr. Belke indicated it would cost a lot more and he may have to move electrical. He reiterated <br /> 26 his request to build a nice garage right where the neighbors are used to seeing it. <br /> 27 <br /> 28 Commissioner Niccum stated that the Planning Commission does not have any plans showing <br /> 29 what the new structure will look like. <br /> 30 <br /> 31 Mr. Belke advised that the footprint will be the same and the garage will be trussed, on center, <br /> 32 with the electrical brought up to Code. <br /> 33 <br /> 34 Chair Jensen stated the property owner proposes to use the garage in a manner that is consistent <br /> 35 with the Zoning Code. <br /> 36 <br /> 37 The Motion was seconded by Commissioner Niccum. <br /> 38 <br /> 39 Commissioner Niccum suggested a friendly amendment to request that the applicant <br /> 40 immediately present a drawing and photographs to staff for consideration by the City Council <br /> 41 that will help the City Council in making its decision. <br /> 42 <br /> 43 Motion failed 3-3 (Chaput,Crone,and Poucher opposed). <br /> 44 <br /> 45 Motion by Commissioner Cincoski, second by Commissioner Niccum,to recommend that the <br /> 46 City Council approve the garage setback variance and 308 SF variance request because the <br />
