Application for Zoning Variance <br /> City of Saint Anthony Village <br /> ATTACHMENT to VARIANCE APPLICATION <br /> RE: St. Anthony Village Clinic/ Hennepin County Medical Center <br /> Legal Description <br /> CIC NO 1342 AMCON ST ANTHONY CONDO, UNIT NO 1 <br /> (in accordance with the Lease, Exhibit A-2) <br /> Reason for Variance Application <br /> Statement of Unique Circumstances <br /> St. Anthony Village Clinic/Hennepin County Medical Center has recently opened a new <br /> community clinic in the Shopping Center located at 2748 Hwy 88. The clinic has a large storefront <br /> however, the patient entrance is located to the for right of the store on a fascia that is setback <br /> from the main storefront elevation. It is essential that users of all ages and physical disabilities, <br /> medical conditions understand where the main entry is for ease in approaching the facility, from <br /> vehicular traffic or when being dropped off. <br /> Currently the larger sign centered on the brick fascia is intended to act as identification and <br /> advertising for the clinic as there is not a possibility of ground monument identification. The sign <br /> requiring the Variance on the setback elevation is meant to direct users to the entrance in a more <br /> user friendly manner while providing lighting on the "Entrance" letters and sidewalk.. <br /> The signage has been designed with down lighting to illuminate the "Entrance" non illuminated <br /> letters which are essential during when daylight savings time is not in use during the dark winter <br /> months. <br /> The signage for each wall surface is less than 15%of the wall surface per (11) Signs on walls. Wall <br /> signs having a sign surface area exceeding 15%of the area of the wall <br /> surface to which it is affixed; <br /> This Variance Request is for the allowance of two identification signs on one frontage. <br /> The current sign code within this C = Commercial District reads as follows: <br /> (B) Commercial and limited business. The following signs are allowed in a"B"Service Office Limited <br /> Business District and"C"Commercial Districts and may be installed after obtaining a permit and <br /> Paying a required license fee. <br /> (1) One identification sign per right-of-way frontage per commercial establishment. The sign may <br /> have no more than 2 square feet of surface area per lineal foot of business frontage, up to a <br /> maximum of 150 square feet.The total area of all wall signs affixed to a wall may not exceed 15% <br /> of the total area of that wall. <br /> The Subject matter of the application is within the scope of this section: <br /> 2) Strict enforcement would cause practical difficulties because: <br /> (a) The property owner proposes to use the property in a reasonable manner not <br /> permitted by the zoning code. <br /> (b) The plight of the property owner is due to circumstances unique to the property not created by <br /> the property owner. <br /> (c) The variance, if granted, will not alter the essential character of the locality. <br /> (d) Economic considerations alone are not the basis of the practical difficulties. <br /> (3) The variance, if granted, would be consistent with the city's comprehensive land use plan. <br /> (4) The granting of the variance is in harmony with the general purposes and intent of the zoning <br /> code. <br />
