Petition. Upon receipt of a petition signed by 30 percent of the persons <br />voting at the last city election or 200 registered voters residing in the city, whichever is less, a <br />statutory city or home rule charter city of the fourth class shall place before the voters of the <br />city the question of whether the city will issue intoxicating liquor licenses. <br />Subd. 2. Ballot question. The question of the referendum under this section must be on <br />a separate . ballot and must allow the voters to vote either "for license" or "against license" <br />Subd. 3. Effect of election results. If a majority of persons voting on the referendum <br />question vote "against license," the city may not issue intoxicating liquor licenses until the <br />results of the referendum have been reversed at a subsequent election where the question has <br />been submitted as provided in this section. <br />Subd. 4. Certification to secretary of state. The clerk or recorder must certify results <br />of a referendum held under this section to the secretary of state within ten days of the election. <br />Subd. 5. Challenge of election. Where the results of a referendum under this section are <br />challenged by any voter, the county attorney of the county inhere the election was held must <br />appear in defense of the validity of the election. <br />History: 1985 c 305 art 6 s 16; 1987 c 152 art 1 s 1; 1994 c 611 s 14 <br />340A.417 SHIPMENTS INTO MINNESOTA. <br />(a) Notwithstanding section 297C.09 or any provision of this chapter, a winery licensed <br />in a state which affords Minnesota wineries an equal reciprocal shipping privilege may ship, <br />for personal use and not for resale, not more than two cases of wine, containing a maximum <br />of nine liters per case, in any calendar year to any resident of Minnesota age 21 or over. Deliv- <br />ery of a shipment under this section may not be deemed a sale in this state. <br />(b) The shipping container of any wine sent into or out of Minnesota under this section <br />must be clearly labeled to indicate that the package cannot be delivered to a person under the <br />age of 21 years. <br />(c) No person may (1) advertise shipments authorized under this section, or (2) by ad- <br />vertisement or otherwise, solicit shipments authorized by this section. No shipper located <br />outside Minnesota may advertise such interstate reciprocal wine shipments in Minnesota. <br />(d) It is not the intent of this section to impair the distribution of wine through distribu- <br />tors or importing distributors, but only to permit shipments of wine for personal use. <br />History: 1993 c 350 s 12 <br />340A.418 NINE TASTINGS. <br />Subdivision 1. Definition. For purposes of this section, a "wine tasting" is an event of <br />not more than four hours' duration at which persons pay a fee or donation to participate, and <br />are allowed to consume wine by the glass without paying a separate charge for each glass. <br />Subd. 2. Tastings authorized. (a) A charitable, religious, or other nonprofit organiza- <br />tion may conduct a wine tasting on premises the organization owns or leases or has use do- <br />nated to it, or on the licensed premises of a holder of an on --sale intoxicating liquor license <br />that is not a temporary license, if the organization holds a temporary on—sale intoxicating <br />liquor license under section 340A.404, subdivision 10, and complies with this section. An <br />organization holding a temporary license may be assisted in conducting the wine tasting by <br />another nonprofit organization. <br />(b) An organization that conducts a wine tasting under this section may use the net pro- <br />ceeds from the wine tasting only for: <br />(1) the organization's primary nonprofit purpose; or <br />
