zs <br />Building Inspection Services Agreement <br />Page 2 <br />8. The Building Official shall provide all job site inspections on projects under <br />permit as required by the Uniform Building Code and under the city zoning <br />code upon request of City staff. Daily inspections shall be logged by the <br />Building Official in a manner established by the City. Inspection times shall <br />be established between the Building Official and the property owner; <br />requests for inspection shall, to the extent possible, be performed within 24 <br />hours of the request for inspection. <br />9. Building Official shall have the exclusive initial authority to determine <br />interpretations and applications of the building and plumbing codes to <br />projects within the City. However, the Building Official shall confer with the <br />City Manager before issuing any such interpretations and applications of <br />these codes that might have a significant or unusual effect on projects <br />within the City. <br />10. The Building Official shall have the right and responsibility to issue stop <br />orders and citations on violations of the building code on any project <br />determined not to be in compliance with the terms and provisions of the <br />building code. The Building Official shall issue stop orders and citations on <br />violations of the zoning code upon request of City staff. Enforcement and <br />prosecution of the building and zoning code requirements by way of judicial <br />action shall be the responsibility of the City. However, the Building Official <br />shall cooperate in any enforcement procedures. <br />11. The Building Official shall be responsible for completing monthly reports to <br />the Metropolitan Waste Control Commission and quarterly surcharge reports <br />to the State of Minnesota. These reports are to be submitted to the City, <br />who will arrange for any necessary payment. The Building Official shall also <br />be responsible for compiling a year -end report of building activity within the <br />City by January 15 of each year. <br />12. The Building Official shall visit the City Hall building on a daily basis to <br />approve permits, return telephone calls, and make record of inspections <br />performed. The Building Official shall notify City Hall when a daily visit is <br />not possible due to vacation, illness, training, or weather conflict. <br />II. COMPENSATION TO BUILDING OFFICIAL. <br />1. The Building Official shall be compensated for building inspection services at <br />60% of the building permit and plan check fees exclusive of the state <br />surcharge and any other fees. <br />
