.2-7 <br />Building Inspection Services Agreement <br />Page 4 <br />its officers, agents, and employees against and hold City, its officers, <br />agents, and employees harmless from any claims, causes of action, <br />damages, loss, cost, or expense resulting from or related to the actions of <br />the Building Official, its officers, agents, or employees in the performance of <br />this agreement. <br />6. The Building Official, its officers, agents, and employees do not assume <br />liability for any negligent or intentional acts of the City or any of its officers, <br />agents, or employees. The City shall indemnify and defend Building Official, <br />its officers, agents, or employees against and hold City, its officers, agents, <br />and employees harmless from any claims, causes of action, damages, loss, <br />cost, or expense resulting from or related to the actions of the City, its <br />officers, agents, or employees in the performance of this agreement. <br />7. It is understood that the enforcement and administration of the Minnesota <br />State Building Code is a public service and is of necessity limited in nature. <br />Consequently, building permits and the subsequent building inspections are <br />not to be construed or relied upon as any type of warranty, guarantee, or <br />representation on the part of the Building Official. <br />8. The City shall defend the Building Official in matters of liability as required by <br />the Uniform Building Code (Section 104, 1994 edition). <br />IV. EFFECTIVE AND TERMINATION DATES <br />1. Effective Date. This agreement shall be effective as of the date set forth in <br />the first paragraph of this document and shall continue in full force and <br />effect until terminated pursuant to paragraph IV. 2. below. This agreement <br />shall supersede all previous contracts or arrangements for building inspection <br />services. <br />2. Termination. This agreement shall continue in full force and effect unless: <br />a. Either party gives thirty (30) days written notice of cancellation to the <br />other party. <br />b. Building Official allows his State of Minnesota certification or worker's <br />compensation insurance expire, in which case the City may cancel the <br />agreement upon the effective date of the expiration. <br />
