Third reading of the ordinance is <br />3 scheduled for the March 10, 2009 City Council meeting. The re- codification will take effect <br />4 April 1, 2009 in order to give the Police Department time to work with County staff. <br />Motion by Councilmember Gray, seconded by Councilmember Thuesen, to approve Second <br />Reading of Ordinance 09 -001, an Ordinance Adopting the Re- Codified City Code. <br />9 Motion carried unanimously. <br />10 <br />11 G. Consider Ordinance 09 -003: Planning Commission Compensation. Mike Morrison, City <br />12 Manager, presenting (first reading). <br />13 <br />14 City Manager Morrison reviewed the ordinance with the Council and indicated that Council has <br />15 requested staff to prepare a revision to Section 305.04, Planning Commission Compensation. <br />16 Currently, Section 305.04 provides financial remuneration on a monthly basis for the Planning <br />17 Commission members to compensate them for their expenses to attend monthly meetings. The <br />18 proposed change to the Ordinance compensates the Planning Commission at $25 per meeting <br />19 attended, rather than $25 per month. Staff recommends waiving the second and third readings of <br />20 the proposed ordinance. <br />21 <br />22 Councilmember Roth questioned how Planning Commission compensation is handled in other <br />23 cities. City Manager Mornson replied most cities do not actually compensate the Planning <br />24 Commission. However, cities that are outside of the metro area do provide compensation, which <br />25 is an incentive for members to apply to serve on the commission. <br />26 <br />27 Mayor Pro Tern Still commented that the compensation is a small thank you to the <br />28 commissioners for their service. He noted the commissioners drive to sites, conduct research and <br />29 contemplate things such as variance requests and replattings. <br />30 <br />31 Motion by Councilmember Thuesen, seconded by Councilmember Roth, to approve the First <br />32 Reading, Waive the Second and Third Readings, and adopt Ordinance 09 -003; Planning <br />33 Commission Compensation. <br />34 <br />35 Motion carried unanimously. <br />36 <br />37 H. Consider Resolution 09 -027: A Request to Keep three Hen Chickens as Pets in the R -3 <br />38 Zoning District. Mike Momson, City Manager, presenting, <br />39 <br />40 City Manager Mornson reviewed the resolution with the Council and indicated that staff received <br />41 a request from Mr. Todd Roepke, 3901 Foss Road, to be allowed to house three hen chickens. <br />42 Included with his request, Mr. Roepke provided signature pages from some of his neighbors. He <br />43 also provided additional information regarding chickens as pets from various sources. The City <br />44 Ordinance is silent on the keeping of animals in any zoning district. Section 1210.02 states <br />45 "Keeping of Certain Animals states that certain animals cannot be kept closer than 500 feet to <br />46 any human habitation of platted land, without the approval of the City Council." 3901 Foss Road <br />
