Consider Resolution 05 -033, re: Designating the National Incident Management Svstems <br />2 (NIMS) as the basis for all incident management in the City of St. Anthony - Chief Malenick <br />3 presenting, <br />4 Chief Malenick stated this is a comprehensive incident (emergency) response system developed <br />5 by the Department of Homeland Security at the request of the President. This organizational <br />6 structure allows many entities to work together in a disaster. He said he has been using the <br />7 Incident Command System. He noted that adopting this program means more training. He <br />8 further noted that state and local governments must adopt the NIMS in order to receive future <br />9 funding. He said that if this is not adopted, the City would not be eligible for grants. <br />10 <br />11 Mayor Faust said as he understands it, this is a command and control system that's needed when <br />12 others have broken down. When national incidents happen, the coordination of federal and state <br />13 is necessary. <br />14 <br />15 Chief Malenick said that it is not necessarily only for if systems break down, but also if a certain <br />16 department is overwhelmed. <br />17 <br />18 Motion by Councilmember Gray, seconded by Councilmember Thuesen, to adopt Resolution 05- <br />19 033, re: Designating the National Incident Management Systems (NIMS) as the basis for all <br />20 incident management in the City of St. Anthony. <br />21 <br />22 Motion carried unanimously. <br />L4 C. Consider Resolution 05 -034, re: Adopt Third Amendment to redevelopment agreement with <br />25 Apache Redevelopment, LLC and update on Silver Lake Village — Stacie Kvilvang Ehlers & <br />26 Associates, presenting. <br />27 Ms. Kvilvang reviewed the resolution with the Council and indicated that this is the third <br />28 amendment to the agreement with Apache Redevelopment LLC. The terms outlined originally <br />29 included the reconstruction of 39`h Avenue. It was determined it would cost $2.2 million. The <br />30 agreement laid out how that would be paid. $1.705 million was assessed to commercial. Since <br />31 that time, the properties have come in and been platted. A request for reassessment is before the <br />32 Council. The anchor tenant was going to pay $1.2 million of the $1.705 million of commercial <br />33 assessments. Now that they have all been platted, the Commercial Developer has requested the <br />34 final special assessment amounts be changed to reflect their share based on actual square <br />35 footage. The anchor tenant would now pay $1.1, and the other businesses would pay $600,000. <br />36 She added that this does not hurt the city financially. <br />37 <br />38 Councilmember Stille asked if there will be costs to refinance the bonds. He asked if there <br />39 would be a good chance that they would be paid off in the fall when the reassessments are levied. <br />40 Ms. Kvilvang answered there is a listing of prepaid assessments, which is the anchor tenant. <br />41 Others will only pay over time. She noted there are several properties along Stinson that have <br />42 repaid and, stated they will look into the situation. <br />43 <br />44 Motion by Councilmember Stille, seconded by Councilmember Gray, to adopt Resolution 05- <br />034, re: A third amendment to a redevelopment agreement by and among the City of Saint <br />4u Anthony, Minnesota, the Housing and Redevelopment Authority of the City of Saint Anthony, <br />47 Minnesota, and Apache Redevelopment, LLC (The "Developer "), dated December 19, 2003. <br />
