CITY OF ST. ANTHONY VILLAGE <br />STATE OF MINNESOTA <br /> <br />RESOLUTION 16-066 <br /> <br />A RESOLUTION AUTHORIZING THE MAYOR OF ST. ANTHONY VILLAGE TO EXECUTE AN <br />AMENDED SETTLEMENT AGREEMENT WITH THE UNITED STATES ARMY TO RESOLVE <br />CLAIMS FOR 1,4 DIOXANE DIOXANE CONTAMINATION EMANATING FROM THE TWIN <br />CITIES ARMY AMMUNITION PLANT <br /> <br /> <br />WHEREAS, in 1989 the City and the United States Army (“Army”) entered into a Settlement Agreement <br />resolving claims brought by the City against the Army for groundwater contamination caused by <br />operations at the Twin Cities Army Ammunition Plant (“TCAAP” and “TCAAP Agreement”). <br /> <br />WHEREAS, the Agreement resolved claims arising from pollutants then-known to be present in the TCAAP <br />contamination plume, but the City reserved rights to bring future claims arising from new <br />pollutants that might later be discovered. <br /> <br />WHEREAS, in 2015 the contaminant 1,4 Dioxane was discovered in the aquifers underlying the City, and the <br />City made additional claims against the Army. <br /> <br />WHEREAS, representatives of the City and Army have reached agreement on a First Amendment (“First <br />Amendment”) to the TCAAP Agreement, which will provide additional compensation to the <br />City fund new treatment technology to address the 1,4 Dioxane contamination. <br /> <br />NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saint Anthony does hereby <br />approve the following: <br /> <br /> 1. First Amendment to the TCAAP Agreement <br /> <br />BE IT FURTHER RESOLVED, that the Mayor is authorized to execute the same on behalf of the City. <br /> <br />Adopted this 13th day of September, 2016. <br /> <br /> ____________________________________ <br /> Jerome O.
