CITY OF ST. ANTHONY VILLAGE <br />STATE OF MINNESOTA <br />RESOLUTION 16 -066 <br />A RESOLUTION AUTHORIZING THE MAYOR OF ST. ANTHONY VILLAGE TO EXECUTE AN <br />AMENDED SETTLEMENT AGREEMENT WITH THE UNITED STATES ARMY TO RESOLVE <br />CLAIMS FOR 1,4 DIOXANE DIOXANE CONTAMINATION EMANATING FROM THE TWIN <br />CITIES ARMY AMMUNITION PLANT <br />WHEREAS, in 1989 the City and the United States Army ( "Army ") entered into a Settlement Agreement <br />resolving claims brought by the City against the Army for groundwater contamination caused by <br />operations at the Twin Cities Army Ammunition Plant ( "TCAAP" and "TCAAP Agreement "). <br />WHEREAS, the Agreement resolved claims arising from pollutants then -known to be present in the TCAAP <br />contamination plume, but the City reserved rights to bring future claims arising from new <br />pollutants that might later be discovered. <br />WHEREAS, in 2015 the contaminant 1,4 Dioxane was discovered in the aquifers underlying the City, and the <br />City made additional claims against the Army. <br />WHEREAS, representatives of the City and Army have reached agreement on a First Amendment ( "First <br />Amendment ' ) to the TCAAP Agreement, which will provide additional compensation to the <br />City fund new treatment technology to address the 1,4 Dioxane contamination. <br />NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saint Anthony does hereby <br />approve the following: <br />1. First Amendment to the TCAAP Agreement <br />BE IT FURTHER RESOLVED, that the Mayor is authorized to execute the same on behalf of the City. <br />Adopted this 13s' day of September, 2016. <br />Jerome O.
