Klein <br /> <br /> <br />ORDER GRANTING DEFENDANTS’ <br />MOTION FOR PARTIAL JUDGMENT <br />ON THE PLEADINGS AND DENYING <br />PLAINTIFFS’ MOTION FOR <br />SUMMARY JUDGMENT <br /> <br /> <br />On August 26, 2016, the above-captioned matter came on before the Honorable Joseph R. <br />Klein, Judge of District Court, on Defendants’ The Village, LLC and Lowry Grove Partnership, <br />LLP (collectively “Defendants”) Motion for Partial Judgment on the Pleadings and Plaintiffs <br />Aeon, Maria Antonia Alvarez Baez, and Lowry Grove Resident’s Association (collectively <br />“Plaintiffs”), Motion for Declaratory Partial Summary Judgment. Rachel Osdoba appeared on <br />behalf of Aeon. John Cann appeared on behalf of Maria Antonia Alvarez Baez and Lowry Grove <br />Residents Association. Eric Magnuson appeared on behalf of the Village, LLC. Peter Diessner <br />appeared on behalf of Lowry Grove Partnership, LLP. Based upon the files and proceedings herein, <br />the Court makes the following: <br />ORDER <br />1. Defendants’ motion for partial judgment is GRANTED. <br /> <br />2. Counts I, II, III (except as it relates to relief for monetary damages), IV, and V of the <br />Complaint are hereby DISMISSED. <br /> <br />3. Genuine issues of material fact exist regarding whether Plaintiffs complied with the <br />requirements of the statute. Plaintiffs’ motion for declaratory partial summary judgment <br />is DENIED. <br /> <br />31
