NOTICE OF PUBLIC HEARING CONTINUATION <br /> <br />CITY OF ST. ANTHONY <br />STATE OF MINNESOTA <br /> <br /> NOTICE IS HEREBY GIVEN that the City Council of the City of St. Anthony, Hennepin <br />County, State of Minnesota, received a statement from the private owner of the Lowry Grove <br />Manufactured Home Park (“the Park”), Continental Property Group (“Continental”), communicating <br />Continental’s intention to close the Park, regardless of the outcome of any pending litigation over the <br />validity of its purchase of the Park. The City Council also received from Continental its agreement: 1) to <br />reimburse the Minnesota manufactured home relocation trust fund (“Trust Fund”) for relocation <br />compensation payments made to relocated residents up to the amounts and on the timelines provided in <br />Minn. Stat. § 327C.095; and 2) to waive any argument or claim challenging any compensation paid from <br />the Trust Fund to relocated residents, regardless of whether the Park is ultimately closed. In addition, the <br />Hennepin County District Court has issued an order ruling that Continental’s ownership of the Park, and <br />thus its right to close it, may not be invalidated even if the Court later decides that the sale of the Park to <br />Continental violated Minnesota’s manufactured home park closure statute. Therefore, in order to allow <br />for residents who will be relocated to receive prompt compensation, the City has determined that it is <br />appropriate to continue the public hearing required under St. Anthony Code Section 111.094 and <br />Minnesota Statutes Section 327C.095, subd. 4 that was held but not concluded on September 8, 2016. <br /> <br />NOTICE IS HEREBY GIVEN that the public hearing held on September 8, 2016 on the closure <br />of the Lowry Grove Manufactured Home Park will be continued to Tuesday, October 11, 2016, at <br />approximately 7:00 P.M. at the St. Anthony City Council Chambers in City Hall, 3301 Silver Lake Road, <br />Minnesota. The public hearing will: review the closure statement provided by Continental to residents <br />and home owners of the Park; review and evaluate impacts the planned closure may have on <br />manufactured home owners and on Continental; inform Park residents and home owners of their potential <br />eligibility for relocation compensation from the Minnesota Manufactured Home Relocation Fund (“the <br />Fund”) under Minnesota Statutes Section 327C.095, subdivision 13 and Minnesota Statutes Section <br />462A.035; and appoint a neutral third party to exercise decision-making authority and resolve questions <br />and disputes regarding contributions to and disbursements from the Fund. <br /> <br /> All interested persons may appear at the hearing and present their views on the Park closure and <br />the neutral third party orally or prior to the meeting in writing. <br /> <br /> Residents seeking information on the Minnesota Manufactured Home Relocation Fund may <br />contact the Minnesota Housing Finance Agency at 651-296-3617. <br /> <br />BY ORDER OF THE CITY COUNCIL OF <br /> THE CITY OF ST.
