Attachment I -A <br />State of Minnesota <br />General Obligation Bond Financed <br />CERTIFICATION <br />The undersigned hereby certifies as follows: <br />® This Certification is being submitted pursuant to the Waiver of Real Property Declaration <br />granted by Minnesota Management and Budget to Metropolitan Council for Municipal Publicly - <br />Owned Infrastructure Inflow/Infiltration projects or the portions thereof which lie entirely within <br />public road, street and highway rights -of -way and utility easements. <br />[Grantee] certifies that [Grantee] has read and will comply with the terms and conditions of <br />the Waiver of Real Property Declaration, a copy of which is attached to this Certification and <br />further, that the Governmental Program which is the subject of and described in the Municipal <br />Publicly -Owned Infrastructure Inflow/Infiltration Grant Agreement [No., between <br />[Grantee] and Metropolitan Council qualifies for the Waiver of Real Property Declaration. <br />The undersigned owns ❑ fee title to property and /or ® permanent easement and/or ❑ <br />other easement which meets the requirements of this Agreement for wastewater collection <br />purposes and/or permit for pipe in City of St. Anthony Village public right of way which meets <br />the requirements of this Agreement for wastewater collection purposes and a wastewater <br />collection system within the fee title, permanent easement, and/or the other easement and <br />wastewater collection system being located in Hennepin and Ramsey County, Minnesota. The <br />fee title property, permanent easement and/or other easement and the wastewater collection <br />system therein is referred to as "Restricted Property" and is described in Exhibit A attached <br />hereto by legal description, narrative description or diagram. <br />As the owner of the Restricted Property, the undersigned hereby acknowledges the <br />following restrictions and encumbrances with respect to the Restricted Property: <br />A. The Restricted Property is State bond financed property within the meaning of Minn. <br />Star. § 16A.695 that exists as of the effective date of the grant agreement identified in <br />paragraph B below, is subject to the encumbrance created and requirements imposed <br />by such statutory provision, and cannot be sold, mortgaged, encumbered or otherwise <br />disposed of without the approval of the Commissioner of Minnesota Management and <br />Budget, or its successor, which approval must be evidenced by a written statement <br />signed by said commissioner and attached to the deed, mortgage, encumbrance or <br />instrument used to sell or otherwise dispose of the Restricted Property; and <br />B. The Restricted Property is subject to all of the terms, conditions, provisions, and <br />limitations contained in the G.O Grant agreement between Metropolitan Council and <br />[Grantee], dated <br />ATTACHMENT 1 -A <br />
