CITY OF ST. ANTHONY VILLAGE <br />STATE OF MINNESOTA <br /> <br />RESOLUTION 16-085 <br /> <br /> <br />A RESOLUTION APPROVING CERTAIN REAL ESTATE DOCUMENTS <br /> FOR ST. ANTHONY VILLAGE CENTER <br /> <br /> <br /> <br />WHEREAS, the current owner of St. Anthony Village Center located at 2702 – 2714 County Road 88;, <br />Daniel Shattuck, desires to sell the property to John Trautz of Trautz Properties, LLC, <br />and the prospective owner has separately requested plat, with variances in order to <br />remove the Common Interest Community plat, the Condo Association and to replace the <br />CIC and Condo Association with an easement agreement; and <br /> <br />WHEREAS, City staff and attorneys have negotiated substantially complete versions of the required <br />real estate transactional documents. <br /> <br />NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of St. Anthony does hereby <br />approve the following documents to be finalized and executed on behalf of the City by <br />the Mayor and City Manager in consultation with the City Attorney: <br /> <br />1) Reciprocal Easement and Restriction Agreement; <br />2) Payment lieu of taxes agreement; <br />3) Termination of common interest community agreement and recording of certificate of <br />termination; and <br />4) Quit claim deeds and other required ancillary real estate documents. <br /> <br /> <br /> <br />Adopted this 22nd day of November, 2016. <br /> <br /> <br />_________________________________________ <br /> Jerome O.
