ANTHONY VILLAGE <br />STATE OF MINNESOTA <br /> <br />ORDINANCE NO. 2017-02 <br />AN ORDINANCE ADDING CHAPTER 132 PREDATORY OFFENDERS <br />The City Council of the City of St. Anthony Village ordains as follows: <br />Section One. Amendment to the City of Saint Anthony Village City Code to Add Chapter <br />132 of the City Code of the City of Saint Anthony Village is hereby amended as follows. The <br />deleted language is represented by strikethrough text. The additional language is represented by <br />double underlined text. <br /> <br />SECTIONS: <br /> <br />132.1 : Intent <br />132.2 : Definitions <br />132.3 : Prohibited Location of Residence <br />132.4 : Exceptions <br />132.5 : Penalties <br /> <br /> <br />132.1 : INTENT <br /> <br />It is the intent of this chapter to serve the city’s compelling interest to promote, protect, and <br />improve the health, safety, and general welfare of St. Anthony citizens by creating areas around <br />locations where children are known to regularly congregate in concentrated numbers wherein <br />certain predatory offenders are prohibited from establishing temporary or permanent residence. <br /> <br />132.2 : DEFINITIONS <br /> <br />The following words, terms, and phrases, when used in this chapter, shall have the meanings <br />ascribed to them, except where the context clearly indicates a different meaning: <br /> <br />DESIGNATED PREDITORY OFFENDER. Any person who has been categorized as a Level <br />III predatory offender under Minnesota Statutes Section 244.052, a successor statute, or a similar <br />statute from another state in which that person’s risk assessment indicates a high risk of re- <br />offense. <br /> <br />PERMANENT RESIDENCE. A place where a person abides, lodges, or resides for 14 or more <br />consecutive days. <br /> <br />TEMPORARY RESIDENCE. A place where a person abides, lodges, or resides for a period of <br />14 or more days in the aggregate during any calendar year and which is not the person’s <br />permanent address, or a place where the person routinely abides, lodges, or resides for a period <br />of four or more consecutive or non-consecutive days in any month and which is not the person’s <br />permanent residence. <br /> <br />SCHOOL. A public or nonpublic elementary or secondary school. <br />147
