MEMORANDUM <br />To: St. Anthony Village City Council <br />Mark Casey, City Manager <br />From: Breanne Rothstein, AICP, City Planner <br />Date: May 15, 2017 <br />City Council Regular Meeting for May 23, 2017 <br />WSB Project No. 02170 -390 <br />Request: Request to keep four (4) female chickens in an R -1 Zoning District at 3626 <br />Belden Or NE <br />BACKGROUND /ANALYSIS <br />Staff received a request letter and a coop site plan diagram from the Applicants on May 9th. The coop <br />site plan diagram and the letter submitted describe the location and relative dimension of the chicken <br />coop in relation to their home and other landmarks on the Applicants' property. <br />The site plan shows that the planned location of the coop is the southwest corner of the rear yard. The <br />Applicant's letter describes that corner of the yard as "relatively isolated ", with an 8 -foot fence <br />separating their yard from the neighbor to the west and a shed partially blocking the view from the <br />neighbors to the south. A review of the area confirms that these structures exist and will likely obstruct <br />the view of the coop from the surrounding neighbors' yards. There does not appear to be a fence <br />separating the Applicants property from the property to the south, although there is existing vegetation <br />on both properties that will likely provide some visual screening. <br />In their letter, the Applicants describe the coop's dimension and provide a rendering showing the <br />finished coop's design. The coop has a run enclosure below and an elevated nesting box area above. The <br />original application letter stated incorrect dimensions which the Applicant has since corrected in a <br />correspondence with City staff (included in packet). The coop is of a prefabricated design. The corrected <br />dimensions show that the coop will stand 57 inches (4.75 feet) tall and that the footprint of the entire <br />coop enclosure will be 42 inches wide by 84 inches long, or a 24.5 square feet footprint. Although the <br />coop is designed for as many as 8 chickens, the Applicants state they are planning to keep 4 chickens in <br />their coop. The Applicant has stated that they will be female chickens, thus minimizing concerns about <br />noise. <br />CITY CODE RELATED TO REQUEST <br />Title IX General Regulations, Chapter 91 Animals, Section § 91.56 KEEPING OF CERTAIN ANIMALS states <br />that "No person may keep swine, cattle, horses, goats, or more than 2 dogs or 3 dogs allowed under § <br />91.01 through 91.05 or fowl, within the city nearer than 500 feet to any human habitation or platted <br />land, without approval of the City Council. The City Council may, before approving or denying any <br />request for approval, request a report from the Health Officer concerning the effect on public health." <br />19 <br />
