25 <br />My thFY <br />i la e <br />MEMORANDUM <br />To: St. Anthony Village City Council <br />Mark Casey, City Manager <br />From: Breanne Rothstein, AICP, City Planner <br />Date: May 11, 2017 <br />City Council Regular Meeting for May 23, 2017 <br />WSB Project No. 02170 -390 <br />Request: Request to keep six (6) chickens in an R -1 Zoning District at 3631 Harding St <br />NE <br />RECOMMENDATION <br />Staff received a request letter and a coop site plan diagram from the Applicants on May 9t'. The coop <br />site plan diagram shows the location and relative dimension of the chicken coop in relation to their <br />home and other landmarks on the Applicants' property. <br />The site plan shows that the chicken coop would be adjacent to an existing garden and 18 feet set back <br />from the south property line with the garden separating the coop from the neighboring property to the <br />south. The site plan also shows existing vegetation acting as a partial screening buffer along the eastern <br />property line, and a tall wooden fence along the northern property boundary that would screen the <br />view from the property to the north. The Applicants' property is bounded by a chain link fence on the <br />east and south sides, which does not completely screen the view of the coop from neighboring <br />properties. In their letter, the Applicants describe that they have communicated with and received <br />verbal consent from their neighbors to the east and south regarding their plans to keep a chicken coop <br />in the back yard. <br />In their letter, the Applicants describe the coop's dimension and design and provide a link to the coop <br />that they are planning to purchase. They state, and the link confirms, that the coop will stand 42 inches <br />(3 Y2 feet) tall. The coop will have a 10 % foot by 2 Y4 foot (23 % square foot) footprint. The coop is a <br />prefabricated design with two nesting houses. It is primarily constructed of wood, with a run fully <br />enclosed by a wire grid. Although the coop can fit up to 10 chickens, the applicant states that they are <br />only planning to keep six chickens on their property. <br />CITY CODE RELATED TO REQUEST <br />Title IX General Regulations, Chapter 91 Animals, Section § 91.56 KEEPING OF CERTAIN ANIMALS states <br />that "No person may keep swine, cattle, horses, goats, or more than 2 dogs or 3 dogs allowed under § <br />91.01 through 91.05 or fowl, within the city nearer than 500 feet to any human habitation or platted <br />land, without approval of the City Council. The City Council may, before approving or denying any <br />request for approval, request a report from the Health Officer concerning the effect on public health" <br />The City Council may elect to include reasonable conditions or specifications with a resolution approval, <br />should they deem such conditions appropriate to the intent of the ordinance. <br />
