15 <br />MEMORANDUM <br />To: St. Anthony Village City Council <br />Mark Casey, City Manager <br />From: Breanne Rothstein, AICP, City Planner <br />Date: City Council Regular Meeting for June 13, 2017 <br />WSB Project No. 02170 -390 <br />Request: Request to keep three (3) hens in an R -1 Zoning District at 3313 Wendhurst <br />Ave <br />BACKGROUND /ANALYSIS <br />Staff received a request letter and a coop site plan diagram from the Applicants on May 17`x'. The coop <br />site plan diagram shows the approximate location the proposed chicken coop in the northwest corner of <br />the rear yard of the Applicant's property. <br />The Applicants' letter describes that the coop will be located in the backyard directly behind the garage, <br />and provides an image showing the proposed location in relation to the Applicant's house. The site plan <br />indicates a setback of 35 feet from the rear property line and 22 feet from the side property line. The <br />Applicant states that the coop will not be visible from the vantage of her neighbor's property to the <br />east, and that "a large bush will block the view of the coop for the neighbors on the west side of us." The <br />Applicant further explains that her neighbors to the north will have a "very limited view" of the coop <br />due to the visual obstruction of trees. <br />The Applicant indicates she has spoken to her east and west neighbors about her intent to have chickens <br />on her property and that both neighbors are "supportive of her interest." <br />In her letter, the Applicant describes the coop's dimension as "roughly 4ft by 6ft by 4ft", with the latter <br />dimension being the coop height. She provides an image of the coop she intends to purchase from Fleet <br />Farm, which shows an elevated nesting box and a run fully enclosed with chicken wire. The Applicant <br />has stated that she plans to keep three hens in the coop, and no roosters. <br />CITY CODE RELATED TO REQUEST <br />Title IX General Regulations, Chapter 91 Animals, Section § 91.56 KEEPING OF CERTAIN ANIMALS states <br />that "No person may keep swine, cattle, horses, goats, or more than 2 dogs or 3 dogs allowed under § <br />91.01 through 91.05 or fowl, within the city nearer than 500 feet to any human habitation or platted <br />land, without approval of the City Council. The City Council may, before approving or denying any <br />request for approval, request a report from the Health Officer concerning the effect on public health." <br />The City Council may elect to include reasonable conditions or specifications with a resolution approval, <br />should they deem such conditions appropriate to the intent of the ordinance. <br />
