REPORTS FROM COMMISSION AND STAFF. <br />8 A. Resolution 17 -068: a Resolution denying a request for a 17.5-foot variance to build a <br />9 deck 7.5 feet from the property line at 3113 Edward Street <br />10 <br />I 1 City Planner Rothstein reported today the Applicant withdrew their request for a variance. The <br />12 Council needs not consider the request and a letter will be sent to the Applicant tomorrow <br />13 confirming withdrawal of the variance request. <br />14 <br />15 B. Resolution 17 -069 a resolution approving the minor subdivision request for the properties <br />16 located at 3725 Stinson Boulevard and 3701 Stinson Boulevard <br />17 <br />18 City Planner Rothstein reviewed the minor subdivision to transfer land from the southern lot to <br />19 the northern lot for the purposes of future redevelopment of the 2701 Stinson parcel. The lot line <br />20 adjustment and transfer would add 70 feet to the 3701 Stinson lot and both property owners are <br />21 amenable through provision of Purchase Agreement. The Applicant/Owner is Apache <br />22 Redevelopment, LLC — Len Pratt. The existing land use /zoning designation is High Density <br />23 Residential/Planned Unit Development. The area is zoned Planned Unit Development, which <br />24 requires a development plan for re- development. There are no specified minimum lot sizes <br />25 within the district. The request is consistent with the submitted Development Plan for Silver <br />26 Lake Village. <br />27 <br />28 City Planner Rothstein reviewed the guidance from City Code and noted the City Council may <br />29 waive compliance with the platting requirements of this subchapter and approve by adoption of a <br />30 resolution to that effect based upon findings by the City Council that compliance with the <br />31 platting requirements would create an unnecessary hardship or expense because of the nature of <br />32 the subdivision, and failure to require the filing of a plat does not interfere with the purposes of <br />33 this subchapter and the City Council may consider the number of parcels resulting from the <br />34 subdivision, the complexity of the legal descriptions, the necessity for dedication of streets or <br />35 drainage and utility easements, and the probability of future subdivision of the parcels (relating <br />36 to Section 151 Subdivision Regulations, Section 152.08). <br />37 <br />38 Ms. Rothstein provided an analysis of the request stating it is for a minor lot adjustment, the <br />39 request does not change the land use or alter the site layout, the purchase agreement shows both <br />40 property owners agree to the minor subdivision, and the minor subdivision results in the increase <br />41 of the size of 3701 Stinson lot, making it more likely to redevelop. <br />42 <br />43 City Planner Rothstein stated that Staff has reviewed the proposed minor subdivision and parcel <br />44 transfer requested, and recommends approval of the application, subject on the following <br />45 conditions: <br />46 <br />
