applicants seeking places for assembly within the City and work to treat assemblies <br />equally within the specific zoning districts. This option would also fully preserve the <br />limited land within the light industrial zoning district as an area of the City devoted <br />specifically to industry- oriented development, job creation, and economic growth, and <br />thus meet the City's general planning goals. <br />Overall, Option #3 seems to represent the most appropriate course of action for the <br />Cam. The complete Study, including the basis for this final recommendation, follows in the <br />sections below. <br />2.0 PURPOSEOFSTUDY <br />The goals of the Study are as follows: <br />➢ Determine the City's intended meaning of "assembly" within the Zoning Code; <br />➢ Determine whether the City intended religious assemblies to exist as conditional uses <br />within commercial and light industrial zoning districts; <br />➢ Ensure that any amendments to the City Zoning Code do not conflict with the City's <br />intent in planning for property use within its commercial and light industrial zoning <br />districts; <br />➢ Ensure that, if amended, the Zoning Code is improved in regards to consistency and <br />clarity with respect to the use of "assemblies "; <br />➢ Ensure that the Zoning Code is consistent with federal law; and <br />➢ Respect the current applicant's interests in receiving a reasonable and timely decision <br />regarding the pending application. <br />3.0 ANALYSIS OF CITY OF SAINTANTHONY VILLAGE ZONING CODE <br />This section provides general information regarding the Zoning Code, the particular <br />zoning districts regulated within the Zoning Code, and the reasonable interpretation of Zoning <br />Code language pertaining to "assemblies, meeting lodges, or convention halls." A map showing <br />the general zoning districts of the City is included in Section 3.6. <br />3.1 City of Saint Anthony Village Zoning Code: Intent Purpose and Interpretation <br />The City's Zoning Code is located in Chapter 152 of the City Code. In interpreting and <br />applying the Zoning Code to zoning decisions, the City considers the intent and purposes of the <br />Zoning Code. City Code § 152.004. <br />The general intent of the Zoning Code is "to protect the health, safety, and general <br />welfare of the city and its people through the establishment of minimum regulations governing <br />land development and use."
