JOINT POWERS AGREEMENT EETWEEil <br />RAMSEY COUNW AND CITY OF SAINT ANTHO]IY <br />FOR USE OF YARD WASTE MANAGEMENT SITES <br />USING THE CITY'S ATTOCATION OF SCORE FUNDS <br />This Agreement is entered into pursuant to Minnesota Statutes Section 471.59 between <br />Ramsey County (the "County''), a political subdivision ofthe State of Minnesota, and the <br />City of Saint Anthony (the "City"), a political subdivision of the State of Minnesota. <br />Whereas, Ramsey County operates a yard waste management system, which <br />includes seven sites for the collection of yard waste from Ramsey County residents; and <br />Whereas, Ramsey County provides a portion of its SCORE funds to municipalities <br />for SCORE related activities, and uses some of its SCORE funds for the operation of the <br />County's yard waste sites; and <br />Whereas, the Ramsey County Solid Waste ManaSement Plan states that "Ramsey <br />county will operate a system of yard waste and organic waste recycling sites that are <br />convenient, are provided at no charge to site users, and only for residents of Ramsey <br />County;" and <br />Whereas, a portion of the City of Saint Anthony is within Ramsey County, and City <br />residents within that area may use the County's yard waste sites, but those City residents <br />not in Ramsey County are not allowed to use the County's yard waste sites; and <br />Whereas, the City would like to provide additional yard waste management <br />opportunities to all of its residents, whether they reside in Ramsey County or Hennepin <br />County; and <br />Whereas, Ramsey County is willing to make yard waste services available to the <br />City of Saint Anthony for a reasonable cost, and provide an exception to the policy <br />identified above to address the practical difficulties of providing yard waste services for <br />residents of the City because this City has significant population in the two counties; and. <br />Whereas, the City would forgo using SCORE funds for any purpose other than <br />making the Ramsey County yard waste sites available to all of its residents; Now, <br />therefore, it is agreed: <br />1. COUNTY OETIGATIONS <br />a. The County shall allow all residents of the City, regardless of county of residence, <br />to use County yard waste sites at the same level of service that the sites are <br />available to County residents. <br />b. The County will provide the City with information about site services, hours and <br />dates of operation, and site rules, for use by the City in promoting the sites. <br />25
