Storm Water Management 110 <br /> <br /> <br />SEDIMENT. Solid matter carried by water, sewage, or other liquids. <br /> <br />STRUCTURE. Anything manufactured, constructed, or erected which is normally attached to or <br />positioned on land, including portable structures, earthen structures, roads, parking lots, and paved <br />storage areas. <br /> <br />THIS CHAPTER. This Chapter 153. <br /> <br />WETLANDS. Lands transitional between terrestrial and aquatic systems where the water table is <br />usually at or near the surface or the land is covered by shallow water. For purposes of this definition, <br />WETLANDS must have the following 3 attributes: <br /> <br />(1) Have a predominance of hydric soils; <br /> <br />(2) Are inundated or saturated by surface or ground water at a frequency and duration <br />sufficient to support a prevalence of hydrophytic vegetation typically adapted for life in saturated soil <br />conditions; and <br /> <br />(3) Under normal circumstances support a prevalence of the vegetation. <br />(1993 Code, § 1675.04) <br /> <br /> <br />§ 153.05 SCOPE AND EFFECT. <br /> <br />(A) Applicability. Every applicant for a building permit, subdivision approval, or a permit in the <br />Commercial, Industrial, R-3, and R-4 Zoning Districts of the city must submit a Storm Water <br />Management Plan to the Public Works Director. No building permit, subdivision approval, or permit to <br />allow land disturbing activities shall be issued until approval of the plan or a waiver of the approval <br />requirement has been obtained under this chapter. <br /> <br />(B) Exemptions. The provisions of this chapter do not apply to fences, signs, or poles or <br />emergency work, or to the following items if approved before the effective date of this chapter: <br /> <br />(1) Any part of a subdivision approved by the City Council before the effective date of this <br />chapter; <br /> <br />(2) Any land disturbing activity for which plans have been approved by the watershed <br />management organization; <br /> <br />(3) A lot for which a building permit has been approved; and <br /> <br />(4) Building permits issued in the R-1, R-1A, or R-2 Zoning District. In these districts, the <br />property owner must obtain prior approval from only the Public Works Director of a storm water plan <br />appropriate in scale and scope to the proposed activity when it is over one acre in size. <br />(1993 Code, § 1675.05)
