As a general rule, it is deemed reasonable for the City Council to require as a condition of subdivision, approval dedication of 10% of the total square foot area of the land being subdivided, or the cash contribution provided for in division (B).” The intention is to dedicate an easement around the north building along the trail corridor in addition to the area that is above the 100 year stormwater level, as shown on the attached Park Land Dedication figure. The area provided exceeds the required 10% amount and therefore, Park Dedication requirements would be satisfied. What further information will the Park Commission need for the 3/5/18 meeting to make a determination that no Park Dedication Fee cash contribution is required? If nothing, that simplifies it. Park Commission will be meeting March 5th to review the plat and make a recommendation to Council on the park dedication (at 7 p.m.)
