She <br />holds a Minnesota Child care center License (Rule 3), which is a commercial type license and does <br />not establish a maximum number of children allowed, except through teacher/student ratios and <br />does not require her to live on‐site. She does not live on site and employs a total of three teachers, <br />including herself. <br />Minnesota State Statute protects family childcare centers as a permitted use in the R‐1 district, and <br />family childcare centers are limited to 14 children. Previous to now, it has been staff’s interpretation <br />of the zoning code and the statute that a childcare center having up to 14 children is allowed in the <br />R‐1 district, despite the specific state licensing. <br />The Applicant is requesting an increase in children from 14 to 17 children.
