The existing structure is a duplex, but they have be using it as a single family home for many <br />years. They seek to now re‐use it as a duplex and re‐finance under a two‐unit structure. The property is <br />currently zoned R‐1 Single‐Family, which does not allow two‐family structures. Since they have not been <br />using it as a duplex, they are not eligible for such a use either in the zoning code or under the legal, non‐ <br />conforming use statute.
