<br /> <br /> <br />MEMORANDUM <br /> <br />To: Planning Commissioners <br />From: Breanne Rothstein, AICP, City Planner <br /> <br />Date: Planning Commission meeting on August 27, 2018 <br /> <br />WSB Project No. NA <br />Request: Adminstrative Appeal of Zoning Determination regarding decks <br /> <br /> <br />GENERAL INFORMATION <br />Applicant/Owner: Mary Friend <br />Location: 3331 Edward St <br /> <br />BACKGROUND <br />Mary Friend has requested to build a deck on the rear of their property, but could not meet the setback. <br />They sought a variance for the deck installation, and the City Council denied the request. After several <br />iterations of trying to come to a conclusion that allowed them to build a larger deck and still meet the <br />code, the Friends have submitted an administrative appeal to the zoning determination that: <br />1) A deck is considered a primary structure if connected to the house, and such structure should be <br />subjected to the principal structure setback; and <br />2) That a deck is considered an accessory structure if at least 5 feet away from the home, and <br />therefore subject to accessory structure setback. <br /> <br />APPLICABLE CODES AND STATUTES <br /> Section 155.31 of City Code allows anyone to appeal the zoning decision of the zoning <br />administrator/planner, and applies to “Appeals where it is alleged that there is an error in any order, <br />requirement, decision or determination made by an administrative officer in the enforcement of this <br />chapter” <br /> <br /> Section 150.124 relates to the definition of Accessory Structures. This section has been what <br />staff has used to apply to decks. (ACCESSORY STRUCTURE. A structure subordinate to a principal <br />dwelling not authorized to be used for living or sleeping by human occupants) <br /> <br /> There are currently no regulations specifically regarding decks in the city code. <br /> <br />
