<br /> <br />MEMORANDUM <br /> <br />To: Planning Commissioners <br />From: Breanne Rothstein, AICP, City Planner <br /> <br />Date: Planning Commission worksession on September 24, 2018 <br /> <br />WSB Project No. 011104‐00 <br />Request: Deck Ordinance Discussion <br /> <br />RECOMMENDATION <br />Direct staff to prepare an ordinance and public hearing revising the deck requirements in city code, based <br />on the discussion. <br /> <br />CONSIDERATIONS RELATING TO THE REQUEST <br /> <br />Based on an administrative appeal to staff’s interpretation of the regulations applicable to decks, the <br />Planning Commission directed staff to prepare an ordinance relating to and regulating the setbacks for <br />decks. <br /> <br />Currently the city code does not have any regulations relating to decks. Section 150.124 relates to the <br />definition of Accessory Structures. This section has been what staff has used to apply to decks, but is not <br />ideal in the applicability to decks. <br /> <br />Therefore, a suggested draft ordinance would establish the following provisions: <br /> <br />1) A definition of “deck”. <br />DECK. A platform projecting from the wall of a building or constructed on top of a building designed to <br />be used by people as space which is part of the structure. For the purpose of this Zoning Ordinance a <br />deck is considered attached if any part of it is within five (5) feet of the principal structure. <br /> <br />2) A section that adds “Decks” to the general regulations and add language in “permitted <br />encroachments” relating to decks. <br />3) Setbacks related to decks. <br />(G) Decks not higher than thirty (30) inches above the average adjacent grade must conform to the <br />required accessory structure setbacks of the zoning district; decks higher than thirty (30) inches above <br />the average adjacent grade must follow the principal structure setbacks, except that in rear yard <br />setbacks an encroachment of up to 10 feet into the setback is allowed. <br />RECOMMENDED ACTION <br />Direct staff to prepare an ordinance amending the city code to allow for decks, as stated above, and <br />subject to any additions per Planning Commission.
