Criteria For Variance Approval <br />City Zoning Code, Section 152.245 The City Council must consider the <br />following in determining whether to grant or deny a variance: <br />1.The subject matter is within the scope of this section. Met <br />2.Strict enforcement would cause practical difficulties because: <br />a.The applicant proposes to use the property in a reasonable <br />manner not permitted by the zoning code. Not met <br />b.The circumstances are unique to the property not created by <br />the applicant; Not met <br />c.The variance, if granted, will not alter the essential character <br />of the locality; Not met <br />d.Economic considerations alone are not the basis of the <br />practical difficulties. Not met <br />3.Consistency with the City’s comprehensive land use plan. Not met <br />4.The variance is in harmony with the general purposes and intent <br />of the zoning code. Not met <br />Planning Commission <br />Recommendation <br />Staff recommends that the Planning <br />Commission recommend denial of the lot split <br />and variance, based on review of the criteria. <br />Staff has provided a draft resolution with <br />findings of fact.
