Criteria For Variance Approval <br />City Code, Section 152.245 The City Council must consider whether <br />the request for a variance meets the following criteria: <br />1.Strict enforcement would cause practical difficulties because: <br />a.The applicant proposes to use the property in a reasonable <br />manner not permitted by the zoning code. Not met <br />b.The circumstances are unique to the property and not created <br />by the applicant; Not met <br />c.The variance, if granted, will not alter the essential character <br />of the locality; Not met <br />2.Economic considerations alone are not the basis of the <br />practical difficulties. Not met <br />3.Consistency with the City’s comprehensive land use plan. Not met <br />4.The variance is in harmony with the general purposes and intent <br />of the zoning code. Not met <br />Planning Commission <br />Recommendation <br />On December 17th the Planning Commission held a public hearing and <br />voted unanimously to recommend denial of the lot split and variance, <br />based on review of the criteria. <br />Staff has provided a resolution with findings of fact. <br />25
